Company ("Defendant") alleging that, in collecting consumer debts, Defendant sent electronic mail communications to her and other Florida consumers between the hours of 9 p.m. and 8 a.m. without prior consent, in
violation of the Florida Consumer Collection Practices Act ("FCCPA"). Defendant expressly denies any liability, or that it violated the FCCPA, but has agreed to a settlement to avoid the expense and uncertainty of
continued litigation. </span></span></span></span><span style="font-size:16px;"><span style="line-height:115%"><span style="line-height:115%"></span></span></span></p>
<p style="text-align: justify;"><span style="font-size:16px;"><span style="font-family:Arial,Helvetica,sans-serif;"><span style="line-height:115%"><span style="font-size:12.0pt"></span><span style="line-height:115%">As part of
the settlement, Florida Power & Light Company will no longer send electronic communications to Florida consumers as part of its debt collection efforts between 9 p.m. and 8 a.m. in Eastern Standard Time or
Eastern Daylight Time without the consent of the customer. In addition, the company will provide a total of $500,000 (the "Settlement Fund") to a class of persons in Florida to whom Defendant sent an electronic
communication, between 9 p.m. and 8 a.m. in Eastern Standard Time or Eastern Daylight Time, in connection with the collection of a consumer debt, where the communication was initiated by Defendant between October 16,
2019 and October 15, 2021.</span></span></span></span></p>
<p style="text-align: justify;"><span style="font-size:16px;"><span style="font-family:Arial,Helvetica,sans-serif;"><span style="line-height:115%"><span style="font-size:12.0pt"></span><span style="line-height:115%">The
Settlement Fund will be used to pay pro rata settlement payments to class members who submit a valid and timely claim. Defendant, subject to the Court's approval, will separately pay Class Counsel's reasonable

Desiree Brown v Florida Power & Light Company Settlement
IN THE CIRCUIT COURT OF THE FIFTEENTH JUDICIAL CIRCUIT,
IN AND FOR PALM BEACH COUNTY, FLORIDA

If Florida Power & Light Company sent you an electronic communication, between 9
p.m. and 8 a.m. in Eastern Standard Time or Eastern Daylight Time, in connection
with the collection of a consumer debt where the communication was initiated by
Florida Power & Light Company between October 16, 2019 and October 15, 2021, you
may be entitled to payment from a class action settlement.
A consumer sued Florida Power & Light Company ("Defendant") alleging that, in
collecting consumer debts, Defendant sent electronic mail communications to her
and other Florida consumers between the hours of 9 p.m. and 8 a.m. without prior
consent, in violation of the Florida Consumer Collection Practices Act
("FCCPA"). Defendant expressly denies any liability, or that it violated the
FCCPA, but has agreed to a settlement to avoid the expense and uncertainty of
continued litigation.
As part of the settlement, Florida Power & Light Company will no longer send
electronic communications to Florida consumers as part of its debt collection
efforts between 9 p.m. and 8 a.m. in Eastern Standard Time or Eastern Daylight
Time without the consent of the customer. In addition, the company will provide
a total of $500,000 (the "Settlement Fund") to a class of persons in Florida to
whom Defendant sent an electronic communication, between 9 p.m. and 8 a.m. in
Eastern Standard Time or Eastern Daylight Time, in connection with the
collection of a consumer debt, where the communication was initiated by
Defendant between October 16, 2019 and October 15, 2021.
The Settlement Fund will be used to pay pro rata settlement payments to class
members who submit a valid and timely claim. Defendant, subject to the Court's
approval, will separately pay Class Counsel's reasonable attorneys' fees,
litigation expenses, and costs, the costs of notice and administration of the
settlement, and an additional payment to the Class Representative.
Your Legal Rights and Options In This Settlement: SUBMIT A CLAIM If you submit a
valid claim form by mail or online by June 20, 2022, and if the Court approves
the settlement, you will receive a pro rata payment from the Settlement Fund and
will give up your right to sue Defendant based on any of the released claims.
If you do nothing, you will not receive any funds, and you will also give up
your right to file a lawsuit against Defendant over the released claims. DO

EXCLUDE YOURSELF FROM THE CASE This is the only option that allows you to file a
lawsuit against Defendant on your own regarding the legal claims in this case,
but if you exercise this option, you will not receive a settlement payment. The
deadline for excluding yourself is June 20, 2022. OBJECT TO THE SETTLEMENT Write
to the Court about why you do not believe the settlement is fair, reasonable,
and adequate. The deadline for objecting is June 20, 2022.
