Veterans who served in the military between 2003 and 2015 were typically issued
3M’s dual-ended Combat Arms Earplugs for training and during deployment.

Faulty product design inhibited proper insertion into the users’ ears, and the
earplugs could not maintain a tight seal exposing the soldiers to dangerously
loud sounds.

About 60 percent of veterans that used these earplugs returned from deployments
in Iraq and Afghanistan suffering from hearing loss or tinnitus, according to
the Hearing Health Foundation.

3M lost the first lawsuit to go to trial over the safety of earplugs it sold for
years to the military, with a federal jury Friday awarding $7.1 million to three
veterans and finding the company failed to warn about defects in the product.

The jury awarded each of the three veterans $2.1 million in punitive damages,
plus recoveries for medical expenses, lost earnings and pain and suffering.

Jury verdicts can help set benchmarks for settlement negotiations or provide
support for a company’s strategy to keep defending itself against the claims.
