KONKURRANSER PÅ FACEBOOK – PASS DEG FOR DISSE FALLGRUVENE

Konkurranser på Facebook og sosiale medier er veldig populære og en god måte å
oppnå dynamisk spredning på – men det finnes visse fallgruver man bør se opp
for!

Konkurranser er ok – men ikke lotteri!

Jeg ser ofte konkurranser på Facebook der man bare skal svare på et enkelt
spørsmål, gjette et svar eller helt enkelt bare like og dele et innlegg for å
delta i konkurransen – da klassifiseres det ikke lenger som en konkurranse, men
som et lotteri. For å bedrive lotteri kreves det imidlertid tillatelse fra
Lotteri- og stiftelsestilsynet, noe som per i dag ikke utstedes til
privatpersoner eller selskaper. Her kan du støte på problemer med det norske
lotteritilsynet. Når du bryter lotterilovens bestemmelser, kan det føre til en
politianmeldelse som i sin tur kan lede til rettsforhandlinger og en eventuell
strafferettslig forfølgelse.

Mer om forskjellen mellom konkurranse og lotteri

For at en konkurranse skal kunne klassifiseres som bare en konkurranse, kreves
det at utfallet avgjøres av en form for prestasjon. Det kan være snakk om en
fotokonkurranse, et forslag til slagord eller en form for kunnskapsspørsmål.
Prestasjonsdelen skal imidlertid være av en betydelig art. Er den uanselig, kan
det fortsatt regnes som et lotteri. Her foretas det alltid en helhetsbedømmelse
av et arrangement. Det finnes også andre krav til hva en konkurranse skal
inneholde for å være lovlig, som f. eks. en jury, konkurranseregler etc.

Facebooks krav ved konkurranser

Også Facebook har tydelige regler for hva som gjelder ved konkurranser på
plattformen deres. Deres første krav er at konkurransen skal håndteres på et
lovlig vis. Konkurransen må også inneholde en bekreftelse på at den ikke på noe
vis er sponset, støttet, administrert eller er tilknyttet Facebook. Personlige
tidslinjer eller venne-tagginger får heller ikke brukes i administrasjon av
kampanjer, du kan m.a.o. ikke kreve at noen skal “tagge en venn” eller “dele noe
på sin tidslinje” for å få delta i konkurransen.

Så hva gjør jeg?

Vi syns fremdeles at konkurranser er en ypperlig måte å bygge opp merkevaren og
oppnå dynamisk rekkevidde. Et forslag er at man i innlegget sitt henviser til
konkurranseregler og informasjon på hjemmesiden eller bloggen sin – der man
tydelig presenterer konkurransereglene. Det vil si hvem som utgjør juryen, i
hvilken tidsperiode konkurransen foregår, hva som kreves for å vinne og når og
hvordan vinneren av konkurransen kunngjøres. Gjennom å gjøre det på denne måten
driver du samtidig trafikk til din egen hjemmeside og viser at du er en seriøs
aktør.
