This Privacy Policy applies regardless of the type of device or other means you use to access the Program. American reserves the right to change this Privacy Policy at any time by posting the updated Privacy Policy here along with the date on which the Privacy Policy was changed. This Privacy Policy applies solely to the SimplyMiles® Program. For more information about how American collects, uses, shares and protects information in connection with other products and services offered by American (including without limitation, the AAdvantage® program or bookings and travel on American Airlines), please see the American Airlines Privacy Policy. In the event of a conflict or inconsistency between this Privacy Policy and the American Airlines Privacy Policy, this Privacy Policy shall control with regard to the Program. Information we collect and how we collect it We collect and maintain personal information about you from many sources to understand and meet your needs, manage the Program, and for other purposes disclosed to you. For example, we collect personal information about you from: * You, when you voluntarily provide us with information * Your transactions with American, including through your AAdvantage® account * Payment card networks and/or issuing banks for one or more of your payment cards, subject to you granting consent for any applicable payment card to be linked to the Program * Other third-party sources, such as Participating Merchants. If the information is to be collected directly from you, you may in some cases have the option to decline providing that information. However, your choice to not provide information may impact your use of certain features or services of the Program. The personal information we collect about you through these various sources may include, but is not limited to: * Name, addresses and telephone numbers * Date of birth and gender * Email addresses * AAdvantage® account number * Credit card number(s), which will be used by the applicable payment network * Information related to your transactions with Participating Merchants using the credit card number(s) you provided * Technical information such as your browser type, IP address, type of operating system you use, your geolocation, the name of your internet service provider, mobile advertising identifiers, and pages visited on our site * Information provided via survey, focus group or other marketing research efforts * When you send us an email or online customer service request, we will retain the content of the message, your email address or any contact information you provide, and our response in order to handle any follow-up questions you may have. We also use this information to measure how effectively we address your concerns. * Any other information that you choose to provide to us or that is required to facilitate your transactions and awards. * Your information may be combined with information we may already have about you. Any of the information that we collect through your AAdvantage® account, including your name and email, can only be updated through your AAdvantage® account settings, and not directly via the Program. Automatically collected information (including cookies and geolocation) When you use the Program, we may receive technical information such as your browser type, the type of operating system you use, your geolocation, the name of your internet service provider, mobile advertising identifiers, and pages visited on our site. American gets this information by using technologies, including cookies, web beacons, and mobile device geolocation to provide and improve the Program and advertising, including across browsers and devices (also known as cross-device linking). We also use this information to verify that visitors meet the criteria required to process their requests and for reporting activity in connection with the Program. For example, we may want to know how long the average user spends on our site or which pages or features get the most attention. This technical information may be combined with information that is personally identifiable in order to personalize the Program and advertising to your interests, including across browsers and devices. Please note, however, that while we attempt to safeguard your personal information, no method of transmitting or storing electronic information is ever completely secure. With whom your information will be shared American may share information about you with Participating Merchants, as necessary or appropriate to fulfill the terms of the Program. For example, if you are enrolled in a promotion involving a Participating Merchant, we may share your information with the Participating Merchant as needed for accounting, billing, customer relations, operation of the Program, or to prevent fraud or potentially prohibited or illegal activities. We may also disclose information to companies affiliated with American, our service providers, and/or unaffiliated third parties (i) to provide the Program and (ii) for administrative, analytical, and marketing purposes. Where required by applicable law, we will seek your consent prior to sharing your personal information with such third parties for marketing purposes. These terms of use (“Terms”) apply to all aspects of the Services and the SimplyMiles® Program, and constitute a legally binding agreement between each individual who enrolls in the SimplyMiles® Program or uses the Services (“you” or “your”) and American. GENERAL SIMPLYMILES® PROGRAM TERMS AND CONDITIONS * You are responsible for reading these Terms, the applicable terms and conditions for each Participating Merchant, and additional member information regarding the AAdvantage® program (which is available online at aa.com/AAdvantage®) in order to understand your rights and responsibilities under the SimplyMiles® Program. American may amend the Program Rules at any time in its sole discretion with or without notice. American has no liability for correspondence that is misdirected, lost, stolen, damaged or delayed. * Any AAdvantage® miles earned through the SimplyMiles® program are subject to the AAdvantage® program terms and conditions. For complete details about the AAdvantage® program, visit aa.com/AAdvantage®. * The terms and conditions for our Participating Merchants can be found here. * Fraud, misrepresentation, abuse or violation of any applicable rules (including, but not limited to, the Program Rules) is subject to administrative and/or legal action by appropriate governmental authorities and American. Such action may include, without limitation, the forfeiture of certain or all AAdvantage® miles earned under the SimplyMiles® Program, as well as prohibition of your future participation in the SimplyMiles® Program and/or the AAdvantage® program as a whole. In addition, American reserves the right to take any appropriate legal action to recover damages and other remedies, including its attorneys’ fees incurred in prosecuting any lawsuit against you. * American reserves the right to audit any and all accounts at any time in its sole discretion, with or without notice to you, to ensure compliance with the Program Rules. In the event that an audit reveals discrepancies or violations, the processing of SimplyMiles® Program rewards, AAdvantage® mile accrual and summaries may be delayed until the discrepancies or violations are resolved in a manner satisfactory to American. * If American and/or any Participating Merchant improperly denies you AAdvantage® mile credit or some other benefit, your exclusive remedy shall be the issuance of the improperly denied AAdvantage® mile credit, or such other alternative comparable benefit as determined by American in its sole discretion. American shall have no additional liability whatsoever. In no event shall American or any Participating Merchant be liable to any member, or anyone claiming through a member, for any direct, indirect, consequential or special damages, or any penalties, lost revenue or profits, arising out of the acts or omissions of American or any Participating Merchant in connection with the SimplyMiles® Program. * American is not responsible for and will have no liability arising from products or services offered by any Participating Merchant or any action taken by any Participating Merchant, except as set forth in these Terms. * Accumulation of AAdvantage® miles as a result of Qualifying Transactions with Participating Merchants is subject to the continued participation of such Participating Merchant in the SimplyMiles® Program, which may cease at any time with or without notice. * Members may view their SimplyMiles® Program AAdvantage® mile earning summary on https://www.simplymiles.com/earned * Only individuals are eligible for SimplyMiles® Program membership. Non-individuals, including corporations or other entities, are not eligible to become SimplyMiles® Program members or to accrue AAdvantage® miles. Generally, only the member named on the account will be entitled to access account information. * All Program Rules are subject to interpretation by American. JOINING THE SIMPLYMILES® PROGRAM * Enrollment in the SimplyMiles® Program is free and is available only to individuals over the age of 18 that: (a) are current member of the AAdvantage® Program; (b) possess the legal authority to agree to the Terms; (c) reside in the United States of America; (d) provide valid and accurate personal information when applying for enrollment in the SimplyMiles® Program; (e) are not already members of the SimplyMiles® Program; (f) have not previously been terminated from the SimplyMiles® Program or the AAdvantage® program; and (g) have an eligible payment card account. * Any individual who is not already a member of the AAdvantage® Program may apply to enroll in the AAdvantage® program and obtain an AAdvantage® number at: https://www.aa.com/loyalty/enrollment/enroll. * An individual may apply to enroll in the SimplyMiles® Program by fully and accurately completing an application on this website or through other enrollment channels provided directly by any Participating Merchant. * American reserves the right to change participation eligibility requirements at any time in its sole discretion with or without notice, and has the right to refuse membership to applicants, or terminate membership, in its sole discretion and with or without reason. LIMITS ON REGISTERED CARDS EARNING AADVANTAGE® MILES WITH THE SIMPLYMILES® PROGRAM * To ensure you receive credit for your SimplyMiles® transactions, please retain all receipts until the mileage credit appears on your SimplyMiles® Program earnings summary. * Only registered members of the SimplyMiles® Program will be eligible to earn AAdvantage® miles through the SimplyMiles® Program. * Each Participating Merchant will designate an activity that a SimplyMiles® Program member needs to take with such Participating Merchant in order to receive AAdvantage® miles in connection with this program (a “Qualifying Transaction”). AAdvantage® miles may be awarded to SimplyMiles® Program members for Qualifying Transactions in accordance with any Participating Merchant terms and conditions for each such Participating Merchant or other applicable rules of such Participating Merchant. * AAdvantage® miles will be credited only to the account of the SimplyMiles® Program member who makes a Qualifying Transaction with a Participating Merchant. In accordance with the terms and conditions of each Participating Merchant or other applicable rules of such Participating Merchant, no AAdvantage® miles will be awarded for returned products or certain cancelled services. * You may request AAdvantage® mile credits for past Qualifying Transactions up to twelve (12) months from the transaction date. INTELLECTUAL PROPERTY NOTIFICATIONS * Unless otherwise noted, all information, SimplyMiles® Program account information, AAdvantage® account information, articles, data, images, passwords, Personal Identification Numbers (“PINs”), screens, text, user names, web pages, or other materials (collectively “Content”) appearing on the Services are the exclusive property of American, or its subsidiaries and licensors: * All Content is copyrighted 2019 by American Airlines, Inc. Please assume that everything you see or read on the Services is copyrighted to, or used with permission by, American unless otherwise noted. * The trademarks, logos, service marks, and trade dress (collectively the “Trademarks”) displayed on the Services are registered and unregistered Trademarks of American Airlines, Inc. or others. * Images of people, objects, or places displayed on the Services are either the property of, or used with permission by American. * American owns or uses by permission all software contained on the Services, including without limitation all HTML code and Active X controls. Copyright and other laws and international treaty provisions protect this software. You must access your account information directly through the Services and not through a third party website, including but not limited to any mileage management service, mileage tracking service, or mileage aggregation service. * You agree that you will not misuse the Services. “Misuse” includes, but is not limited to, using the Services to do any of the following: * • Distribute, disseminate, post, or publish any information or material that degrades, embarrasses, harasses, humiliates, intimidates, or threatens any individual or group of individuals on the basis of their age, ancestry, color, ethnicity, marital status, medical condition, mental or physical disability, national origin, race, sex, sexual orientation, union or nonunion affiliation, or any other basis protected by federal, state, or local law or ordinance. * • Abuse, defame, harass, stalk, threaten, or otherwise violate others’ legal rights, including but not limited to rights of privacy and publicity. * • Download or upload files that may damage the operation of another's computer, such as computer viruses, corrupt files, or similar software. * • Download or upload files that contain materials, including but not limited to software that violate the intellectual property, privacy, or publicity rights of others unless you own, control, or have been authorized to exercise such rights. * • Misrepresent or omit the origin or source of any file you download or upload. * • Download or upload files that do not contain the posted proprietary language, author attributions, and/or copyright, patent, or trademark notices. * • Distribute, disseminate, post, or publish any indecent, infringing, obscene, or unlawful information or material. * • Engage in any commercial purpose including but not limited to: Advertising or offering to sell any goods or services; conducting contests or surveys; distributing chain letters, or advertising with respect to any Ponzi scheme or pyramid scheme; advertising or offering to sell any business opportunities, direct sales opportunities, employment, independent contractor positions, multi-level marketing opportunities, or securities. * • Post, send, or otherwise disclose confidential information, trade secrets, or other confidential and/or protected proprietary data of any entity or person, including but not limited to American or any of its affiliates. * • Download or upload files that you know, or reasonably should know, cannot be legally distributed through the Services. * • Upload, download, or otherwise export or re-export software from the Services: (1) to a national or resident of or into any country subject to an embargo by the U.S.; (2) to anyone on the U.S. Treasury Department’s Specially Designated Nationals list, or (3) to anyone on the U.S. Commerce Department's Table of Denial Orders. * • Copy or create derivative works from, display, distribute, license, perform, publish, recreate, reproduce, sell, transfer, or transmit any information, products, services, or software obtained by, from, or through the Services. * • Monitor or copy any Content by using any manual process, or any robot, spider, or other automatic device, without first obtaining American’s prior written consent. * • Act as an agent or attorney in fact for any person who is not a member of your immediate household; or your direct supervisor at your place of employment. * • Take any action that will or could impose an unreasonable or disproportionately large load on the infrastructure of the Services. * • Access information about any AAdvantage® member protected by site log-in and post it on any other website, with or without that AAdvantage® member’s consent. * • Utilize a SimplyMiles® Program member’s or an AAdvantage® member’s password or personal identification number during log-in, unless you are: the member to whom that password or personal identification number is assigned (the “Authorized Member”); a family member of the Authorized Member, acting with the Authorized Member’s permission; or an employee of the Authorized Member’s employer, acting with the Authorized Member’s permission. * • Engage in any other conduct that is, or that American deems to be, in conflict with these Terms. * American forbids such Misuses, and access of the Services for any such Misuses or other similar purposes is an unauthorized use of the Services. In the case of a conflict between these Terms and any agreement specific to any goods, products, or services that you obtain, purchase, or use from the Services, the terms of the specific agreement shall govern. * Any failure of American to assert any rights it may have under these Terms does not constitute a waiver of our right to assert the same or any other right at any other time or against any other person or entity.
