AHLA URGES SENATE TO PASS TAX RELIEF



AHLA is urging the U.S. Senate to quickly pass the Tax Relief for American
Families and Workers Act (H.R. 7024).

The legislation, which already passed in the House, includes vital extensions of
business interest deductibility and bonus depreciation—critical tax relief
policies that support our members’ ability to weather crises and invest for the
future.

What AHLA is doing: This week, AHLA led a letter to Congress signed by the U.S.
Travel Association, National Restaurant Association, International Franchise
Association, and more than 70 state and local organizations urging the Senate to
pass this tax package.

AHLA URGES CONGRESS TO DELAY CORPORATE TRANSPARENCY ACT FILING DEADLINES



AHLA is urging Congress to pass the Protecting Small Business Information Act
(H.R. 4035/S. 3625) to delay the filing deadlines of the Corporate Transparency
Act (CTA).

The CTA subjects millions of small businesses to overly burdensome and
unpredictable compliance requirements, including that they regularly report
sensitive personal information of owners and senior management to the federal
government.

What AHLA is doing: AHLA is vocal about the need to delay the CTA’s
implementation. AHLA signed a letter to House Financial Services Committee Chair
Patrick McHenry and sent a letter earlier this week to Senate Banking, Housing,
and Urban Affairs Committee Chair Sherrod Brown and Ranking Member Tim Scott.


SEC CLIMATE DISCLOSURE RULE FACES LEGAL CHALLENGES



The Securities and Exchange Commission’s (SEC) new climate disclosure rule is
facing mounting legal challenges.

On Monday, the Fifth U.S. Circuit Court of Appeals granted an administrative
stay of the SEC’s climate disclosure rule, providing temporary relief as further
legal challenges unfold. The court order follows swift opposition from
congressional Republicans, industries concerned about compliance costs, and
environmental groups seeking stronger investor protections.

Go deeper: The stay is part of a larger legal landscape with multiple pending
lawsuits across at least six courts. Under the Multicircuit Petition Statute, a
lottery will determine which federal appeals court will hear these cases on a
consolidated basis. In the meantime, the Fifth Circuit’s stay will remain in
place, but the order could be revoked or modified once the cases are
consolidated.

What AHLA is doing: AHLA is closely monitoring the situation and will be hosting
a webinar in the coming weeks (details to come).

IN CASE YOU MISSED IT: AHLA WINS BIG ON JOINT-EMPLOYER



AHLA, the U.S. Chamber of Commerce, and other leading business associations
prevailed in a lawsuit challenging the National Labor Relations Board’s (NLRB)
joint-employer rule.

On March 8, the U.S. District Court for the Eastern District of Texas blocked
the final joint-employer rule ahead of its March 11 effective date and
reinstated a 2020 NLRB rule that protects businesses from undue liability for
employees over whom they do not have direct control.

What AHLA is saying: “This decision is a huge win for hoteliers, the lodging
industry, and franchised businesses,” AHLA Interim President & CEO Kevin Carey
stated. “The ruling will critically reestablish franchisees' control over their
own businesses, restore certainty in the relationships between employees and
employers, and prevent costly confusion with independent contractors.”

What AHLA is doing: AHLA stands ready to fight any attempt by the NLRB to appeal
the court’s decision.

AHLA SHARES RESOURCES AS INDEPENDENT CONTRACTOR RULE TAKES EFFECT



The Department of Labor’s final independent contractor rule is now in effect,
and it changes the way workers are classified as independent contractors or
employees.

The rule will make it much harder for workers to qualify as independent
contractors by setting up a subjective, six-factor test for determining worker
status and creating an undefined set of “additional factors” that might also be
considered. This is a significant departure from the previous test, which relied
on two core factors and created a predictable system that allowed workers to
choose the style of work that suits them best.

What AHLA is doing: AHLA is considering a range of potential next steps against
this rule, including possible litigation. In the meantime, hoteliers should
review their use of independent contractors and consult with an attorney.

AHLA-OPPOSED CHICAGO REAL ESTATE TRANSFER TAX INCREASE ON TRACK TO BE DEFEATED



Chicago voters appear to be on track to reject the ballot measure that would
have increased the real estate transfer tax by up to 300%, with 80% of the vote
in at the time of this publication.

This initiative was a key part of Mayor Brandon Johnson’s agenda. The vote
against one of his landmark proposals is a reflection of Mayor Johnson's
performance as mayor. There are thousands of votes left to be counted, but the
initial returns are favorable for a "no" vote.

The bottom line: The tax was expected to fall primarily on commercial
properties. The measure calls for an increase in real estate transfer taxes from
.075% to 3.0% for properties over $1.5 million. Policies like this in other
cities fail to increase the projected revenue they claim to, all while
depressing the real estate market.

What AHLA is doing: AHLA joined the Illinois Hotel Association, hotel owners,
and other business groups to fund a campaign to oppose the initiative.
