Two U.S. Supreme Court cases could change federal agencies' roles in clarifying
ambiguous laws.
The cases, Loper Bright Enterprises v. Raimondo and Relentless Inc. v. the
Department of Commerce, could overturn what is known as the Chevron deference,
the practice of federal courts deferring to federal agencies when sorting out
ambiguities in a law. Without it, judges could make the call without agency
expertise.
Jim Murphy, the National Wildlife Federation's director of legal advocacy, said
this could have sweeping implications for long-standing environmental laws.
"The agencies would be very hamstrung to interpret provisions about how to, for
instance, regulate mercury coming out of a smokestack," he said, "or how to
regulate PFAS that might be threatening drinking-water supplies."
Murphy said this could make addressing national climate goals more challenging.
He thinks agencies might hesitate to address threats such as climate change and
PFAS or so-called "forever chemicals." The only way around this would be for
Congress to codify the Chevron deference into law.
While this won't affect state law, Murphy said he feels it could be more
difficult for states to have strong climate laws. Eliminating the Chevron
deference could also spur an increase in cases seeking to dismantle laws such as
the Clean Air Act and Clean Water Act. He said the court has used what's known
as the "Major Questions Doctrine" to get around the Chevron deference.
"And the Major Questions Doctrine stands for the proposition that if the court
thinks that an agency is regulating in a way that has major economic or
political implications," he said, "that in order for it to do that, it needs
clear direction from Congress."
One example he cited is Sackett v. EPA, a 2023 case that made it all the way to
the U.S. Supreme Court. The high court narrowed the agency's definition of
"waters of the United States," ending protections for many seasonal streams and
wetlands.

West Virginia and other Appalachian states are littered with hundreds of "zombie
mines," abandoned mines neither producing coal nor undergoing reclamation.
Research shows idle mines can trigger landslides, pollute groundwater and cause
economic harm to communities.
Erin Savage, coal impacts program director for the group Appalachian Voices,
said there is an urgent need to update regulations on zombie mines, especially
since the Biden administration's recently announced federal actions to clean up
abandoned mines do not apply to zombie mines. She noted part of the problem is a
lack of data around what mines are producing coal, are set to be reclaimed, or
have been sitting vacant for decades.
She has been working on a project that aims to better identify zombie mines in
the region.
"One way we're trying to go about doing that is using remote sensing," Savage
explained. "What we're doing is using algorithms to analyze images of the
surfaces of these mines and look for barren earth."
Research shows coal companies' habit of transferring permits and declaring
bankruptcy often delays reclamation and evades responsibility for cleanup. More
than 50 coal companies declared bankruptcy between 2010 and 2019, and 22
additional coal companies declared bankruptcy in 2020 alone.
Congressional lawmakers have introduced three bills to ensure coal companies pay
for the cost of mine cleanup. Savage explains the first bill would eliminate
"self-bonding," essentially a corporate promise companies make to do mine
cleanup.
"The second would make sure that bond amounts are set at an adequate level, so
that there's actually enough money available for the cost -- true cost -- of
reclamation," Savage outlined. "And the third would set better, enforceable
standards about how quickly reclamation needs to happen."
Reclaiming zombie mines could also bring economic opportunities to a region
plagued by unemployment. A 2021 analysis by Appalachian Voices found reclamation
of modern mines in West Virginia and six other states could create up to 45,000
jobs.

West Virginia will receive $140 million to clean up legacy pollution in regions
decimated by decades of coal mining.
The money is part of $725 million in Abandoned Mine Land funding that the Biden
Administration is providing to more than two dozen states.
According to state data, more than 150 years of coal mining has left thousands
of mines abandoned for decades.
In addition to restoring the natural landscape, reducing the odds of landslides
and improving drinking water, repurposing old mine land can bolster local
economies, but first they have to be cleaned up, said Eric Dixon, a senior
researcher at the Ohio River Valley Institute, "making them places that everyday
people can enjoy without fear of some hazard, like an abandoned mineshaft or an
unreclaimed strip mine."
The funding is the third in a series of federal investments in abandoned mine
land funding allowed through the bipartisan Infrastructure Law passed by
Congress in 2021.
Dixon said advocates are pushing for good-paying, family-sustaining jobs created
by the expansion of reclamation work.
"The Biden administration has called for these remediation jobs to be
good-quality union jobs," he said. "We've started to see some of the first union
contracts awarded in states like Kentucky and Ohio, and that's extremely
encouraging."
He said state agencies will funnel the money into projects that close dangerous
mine shafts, reclaim unstable slopes and improve water quality by treating acid
mine drainage.
"Those agencies, they'll identify those projects, they'll design reclamation
projects," he said, "and then they'll actually bid out that reclamation contract
to a construction contractor who will execute the work."
According to the group Appalachian Voices, mountaintop removal mining has
destroyed an estimated one million acres in Central and Southern Appalachia.

The Supreme Court is expected to rule any day now on two cases that could allow
judges to more easily overrule federal agencies, which could have big
implications for environmental, consumer and public health protections.
The two cases -- Loper Bright Enterprises v. Raimondo and Relentless Inc. v. the
Department of Commerce -- aim to overturn the 1984 Chevron deference doctrine
that said when ambiguous statutes are being challenged in court, judges must
defer to the reasonable interpretation of agency experts.
"It would give judges a lot more power to write very impactful regulatory
provisions where those judges really don't have a lot of expertise," said Jim
Murphy, the National Wildlife Federation's director of legal advocacy.
Opponents of the Chevron deference doctrine have said it gives too much power to
the executive branch. The cases stem from a dispute where fishing crews are
challenging requirements that they pay to have a monitor onboard to guard
against overfishing and bycatch of endangered species.
If the Supreme Court invalidates the Chevron deference doctrine, Murphy said, it
would undermine the work of dozens of agencies including the Environmental
Protection Agency, the Food and Drug Administration, the Federal Trade
Commission and the Federal Communications Commission.
"The people who are charged with protecting our public health and protecting our
natural resources are not going to have the tools they need," he said, "and it's
going to result in people getting sick, people dying, places getting polluted.
It's going to have real impact for a very long time."
The Supreme Court generally releases its decisions in mid-June before going into
recess for the summer.
