LEGAL NOTICE OF CLAIMS PROCESS AND PLAN OF DISTRIBUTION NOTICE: You may have a claim for payment of money from a lawsuit. WHAT HAPPENED IN THE LAWSUIT? On November 16, 2021, the Court made a ruling in this lawsuit against the defendant, On Point Global. The Court said that customers can get a refund for money paid to On Point Global and that consumers who provided their information to On Point Global and were not wholly satisfied with their experience on On Point Global’s website can get money. You must submit the Proof of Claim Form by July 17, 2022. If you do not submit it by this deadline, you cannot get any money from this lawsuit. HOW CAN I FILE A CLAIM? You are an “Eligible Claimant” if either (a) you bought a guide from On Point Global in 2017, 2018, or 2019 and you are not satisfied with your purchase (“Paid-Guide Customer”) or (b) you provided your personal information to On Point Global in 2019, and you were not wholly satisfied with what you received from On Point Global (“Freemium Consumer”). All Eligible Claimants received an email with a Customized Notice and a link to your Proof of Claim Form. If you believe you are an Eligible Claimant, but you have not yet received an email containing your Customized Notice and link to access your Proof of Claim Form, please check your spam or deleted mail folders. The Court appointed a person, called a “Receiver,” to pay refunds to anyone with an “Allowed Claim.” To receive a payment, Eligible Claimants must submit a Proof of Claim Form using the customized link provided via email. (You may also file a claim using the File A Claim button above.) If you submit a Proof of Claim Form, you will have an “Allowed Claim” for a distribution of money from On Point Global. HOW MUCH MONEY DO I GET? The amount of money that you receive will depend on the type of claimant that you are and your interactions with On Point Global. Each Eligible Claimant will receive an email that specifies how much money is available for your Claims. Paid-Guide Customers are eligible for a full refund for the amount paid to On Point Global, if the claimant has not already gotten a refund or completed a chargeback. The refund will be for the full price paid to On Point Global (including any processing fees), minus any amounts that were already returned or refunded (for example, if you got a refund, chargeback, or something else). Freemium Consumers are eligible to receive various amounts of money depending on how much personal information was provided and how many people have an Allowed Claim and fill out the Proof of Claim Form. The amount of money you will get will not be more than $15. It might be less than $15 if you did not provide a large amount of personal information to On Point Global or if there are many people who have an Allowed Claim. WHAT DO I HAVE TO DO? To have an Allowed Claim, you must submit the Proof of Claim Form through the online portal. The online portal can be access via a customized link sent to Eligible Claimants, or by clicking the File A Claim button above. When filling out the Proof of Claim Form, you have to agree that certain things are true. -------------------------------------------------------------------------------- Paid-Guide Customers must agree that these three things are true: 1. You are owed the refund amount stated on your online Proof of Claim Form. 2. You are not satisfied with your purchase of the guide offered through the defendants' websites. 3. You have not already received a full refund. The Receiver will calculate how much money you are supposed to get from the lawsuit. The refund or money will be paid to you using the information you gave in the Proof of Claim Form. For Paid-Guide Customers, the Receiver has calculated how much money you are supposed to get from the lawsuit based on the amount you paid and whether you have already gotten any refund. That refund amount appears on your online Notice and Proof of Claim Form. For Freemium Consumers, the Receiver will calculate how much money you are supposed to get from the lawsuit based on the amount of personal information you provided and how many other Eligible Claimants with an Allowed Claim submit a Proof of Claim Form. WHAT IS THE STATUS OF MY CLAIM? If you have already submitted a Proof of Claim Form, you may review the status of your claim using the link provided in your claim confirmation email. WHEN WILL I RECEIVE MY PAYMENT? Payments will be released after the Receiver has made her determination of allowed claims. The deadline for the Receiver to make her determination is July 27, 2022. Payments may be released before or after that date, and this answer may be updated with additional information from time to time.
