FRAUD ADVISORY NOTICE

Fraud Advisory Notice

Cyber frauds, cybercrimes, or similar crimes using technology are commonly sent
via email, WhatsApp, or social media with the intent to steal sensitive data,
bank account numbers, and wire instructions.

Cybercrime is on the rise, and scammers are impersonating legitimate
organizations and companies with which individuals have business relationships,
posing as clients, suppliers, or employees or executives of said companies and
requesting wire transfers be sent to fraudulent accounts.

Money obtained by these means is generally not recoverable. As such, authorities
are recommending companies adopt measures to prevent them. Following these best
practices, American Industries® has implemented new protocols and shares the
following suggestions to protect our clients and suppliers:

(i) DO NOT TRUST emails containing wire instructions or payment instructions. If
you receive one of these requests, immediately contact the sender at a known
telephone number or via video call to confirm the request;

(ii) DO NOT TRUST emails requesting personal or banking information. These
emails may also include instructions to download a file, click on a link, or do
something that may seem unusual. Make sure you verify the veracity of the
information in the email before taking any of the actions requested;

(iii) ONLY TRUST RELIABLE SOURCES of information and only follow instructions
given by known contacts at American Industries®. Said requests will be carried
out according to the following protocol:

American Industries® accounts receivable personnel or one of its authorized
executives will request a video call with you.
During the call, American Industries® personnel will confidentially share the
details of the necessary change or action to take. If applicable, a written
addendum to the corresponding agreement shall be signed by both parties.

(iv) BEFORE WIRING FUNDS TO AN UNKNOWN ACCOUNT, verify the veracity of the
transaction by contacting a known individual at American Industries® (according
to the protocol above). If you cannot confirm the request and think it may be a
scam, notify all parties to the transaction of the attempted crime and the
possible breach of their personal information.

Authorities recommend you adhere to the following guidelines if you have been
the victim of a cybercrime or suspect your information has been compromised:

Change passwords and/or usernames associated with any account that has or you
suspect has been compromised.
Avoid posting information for account transfers or bank details on social media,
including names of account holders and addresses or any other sensitive data
that could be used by scammers.

Prevention is key to avoiding cyber fraud and protecting all parties’ interests.
Be on the lookout for these types of crimes and notify authorities at the Mexico
District Attorney’s Office if you have been a victim of cyber fraud or suspect a
cybercrime has been committed. Their office has a branch specializing in
technology-based crimes and remote extorsions. In addition, you can also dial
911, and the operator will direct you to the corresponding governmental agency
that can assist you.

 


AVISO DE FRAUDE

Los fraudes cibernéticos, o delitos equiparados, cometidos o que podrían
cometerse empleando recursos tecnológicos con la intención de robar información
sensible, cuentas bancarias e instrucciones para giros de dinero usualmente son
enviados por e-mail, WhatsApp, o redes sociales.

Los delitos informáticos están al alza y los estafadores suplantan la identidad
de organizaciones legítimas o de relaciones comerciales (como clientes,
proveedores o sus empleados o ejecutivos) solicitando el envío de dinero a una
cuenta fraudulenta.

Usualmente no se recupera dinero que se obtiene mediante estos delitos; por ello
las autoridades recomiendan la prevención de dichos fraudes, y para tal efecto
American Industries® ha implementado las siguientes sugerencias y protocolo:

(i) DESCONFIE DE e-mails que contengan instrucciones de pago, en caso de recibir
un correo de esta manera llamar al supuesto remitente mediante un número de
teléfono conocido o por videoconferencia para validar dichas instrucciones;

(ii) DESCONFIE DE e-mails que soliciten información personal o financiera que
pueden contener además una solitud para descargar o de acceso a una liga, o
hacer algo que generalmente sería sospechoso por inusual, y verifique su validez
antes de actuar conforme a las instrucciones de dicho correo.

(iii) CONFIE UNICAMENTE EN FUENTES DE INFORMACION CONOCIDAS, es decir, seguir
instrucciones de personal dentro de la organización de American Industries®
conforme el siguiente protocolo:

Se solicitará una videollamada por parte de personal de cuentas por cobrar de
American Industries® o cualquiera de sus ejecutivos;

En dicha videoconferencia el personal de American Industries® informará de
manera confidencial las particularidades del cambio; y
De ser aplicable, ambas partes firmarán una adenda al contrato correspondiente.

(iv) VERIFIQUE Y NOTIFIQUE antes de transferir fondos a una cuenta apócrifa
verifique con anticipación la validez de la operación confirmando con una
persona conocida dentro de la organización de American Industries® (conforme al
protocolo que antecede) y notifique a las partes que formen parte de dicha
operación la posibilidad de estar involucrado en dicho delito.

Las autoridades también recomiendan:

Cambiar los usuarios y contraseñas asociadas a las cuentas que puedan estar en
riesgo de ser objeto de fraude.
Evitar publicar información para transferencia de fondos en las redes sociales
tales como nombres, y domicilios, o cualquier otra información sensible que
pueda ser usada por delincuentes.

Recordar que la prevención de riesgos es clave para evitar delitos informáticos
y así proteger los intereses de todos, esté alerta y notifique a las
autoridades, en México la fiscalía cuenta con unidades especializadas en delitos
cometidos a través de la tecnologías y extorsión remota. De igual forma puede
llamar al 911 para que la operadora le dirija a la dependencia gubernamental
correspondiente.
