<p>In Consideration of WHITE WATER Classic, LTD. furnishing to me the services and equipment thaI will enable me to participate in the activities in which I will</p>
<p>engage in regard 10 the aforesaid designated whitewater rafting trip, I hereby agree as follows:</p>
<p>1. I hereby acknowledge that I have received a safety talk by a member of the staff of While Water Classic, Ltd" and have read fully and understand the</p>
<p>following notices, warnings, safety precautions, and recommendations:</p>
<p>(a) THE YOUGHIOGHENY HAS BEEN DESIGNATED AS A ClASS V RIVER WHICH IS DEFINED AS HAVING EXTREMELY DIFFICULT LONG, AND VERY VIOLENT RAPIDS WITH HIGHLY CONGESTED ROUTES.</p>
<p>(b) RESCUE CONDITIONS ARE DIFFICULT.</p>
<p>(c) THEBE IS A SIGNIFICANT HAZARD TO LIFE IN THE EVENT OF A MISHAP.</p>
<p>(d) A PARTICIPANT IN THE EVENT OF WHITEWATER RAFTING SHOULD HAVE PREVIOUS EXPERIENCE BEFORE PARTICIPATING IN A COMMERCIAl WHITEWATER TRIP ON THE YOUGHIOGHENY WILD RIVER.</p>
<p>(e) OUTDOOR RECREATIONAL ACTIVlTIES HAVE INHERENT RISKS, DAN.GERS, AND HAZARDS, AND SUCH EXIST IN THE USE OF THE PROPERTY AND EQUIPMENT NEEDED FOR WHITEWATER RAFTING AND RELATED ACTIVITIES.</p>
<p>(f) PARTICIPATION IN WHITEWATER RAFTING AND THE USE OF THE PROPERTY AND EQUIPMENT REQUIRED THEREFORE MAY RESULT IN INJURY AND/OR ILLNESS, INCLUDING, BUT NOT LIMITED TO BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL OR TOTAL</p>
<p>PARALYSIS, DEATH, OR OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY.</p>
<p>(g) THE SAID RISKS AND DANGERS MAY BE CAUSED BY</p>
<p>(i) THE NEGLIGENCE OF THE EMPLOYEES, OFFICERS. AND/OR AGENTS OF WHITE WATER CLASSIC lid.</p>
<p>(ii) THE NEGLIGENCE OF PARTICIPANTS;</p>
<p>(iii) THE NEGLIGENCE OF OTHERS;</p>
<p>(iv) ACCIDENTS;</p>
<p>(v) BREACHES OF CONTRACT; ANDIOR</p>
<p>(vi) FORCES OF NATURE AND/OR OTHER CAUSES. -</p>
<p>(h) RISKS AND DANGERS MAY ARISE FROM FORESEEABLE OR UNFORESEEABLE CAUSES, INCLUDING, BUT NOT LIMITED TO,</p>
<p>(i) GUIDE DECISION. INCLUDING MISJUDGMENT OF TERRAIN, WEATHER, TRAIL OR RIVER ROUTE LOCATION;</p>
<p>(Ii) WATER LEVEL;</p>
<p>(iii) FALLING OUT OF A RAFT, CANOE OR KAYAK;</p>
<p>(iv) DROWNING; AND</p>
<p>(v) SUCH OTHER RISKS, HAZARDS, AND/OR DANGERS THAT ARE INTEGRAL TO RECREATIONAL ACTIViTIES THAT TAKE PLACE IN A WILDERNESS, OUTDOOR, OR RECREATIONAL ENVIRONMENT.</p>
<p>2.White Water Classic, Ltd. shall have the right to take photographs or films of the Subject whitewater rafting trip and to use such photographs or films, including my pictures, for promotional and/or commercial purposes.</p>
<p>3.The venue of any dispute that may arise out of the subject whitewater rafting trip or otherwise between White Water Classics,LId., it's owners, employees and/or agents, and me, shall be in Fayette County, Pennsylvania.</p>
<p>4.I hereby agree and affirm that White Water Classic, ltd., it's owners, employees, and/or agents, have made no representation or warranty of any kind, nature, or description, express or implied, with respect to the subject
whitewater rafting trip, other than those stated herein, and thaI I have not relied upon the skill or judgment of the owners, employees, and/or agents of White Water Classic, ltd., in making my decision to participate in the subject
whitewater rafting trip.</p>
<p>ASSUMPTION OF RISK AND WAIVER AND RELEASE OF LIABILITY I HEREBY ASSUME ALL RISKS, DANGERS, AND RESPONSIBILITY FOR ANY LOSS, HARM, OR DEATH OCCURRING TO ME BY VIRTUE OF MY PARTICIPATION IN THE ACTIVITIES IN WHICH I WILL ENGAGE IN
REGARD TO THE WHITEWATER RAFTING TRIP DESIGNATED ON THE OTHER SIDE OF THIS DOCUMENT, WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OR OTHER CONDUCT OF THE AGENTS, OFFICERS, AND/OR EMPLOYEES OF WHITE WATER CLASSIC, LTD., OR ANY
OTHER PERSON. AND FURTHER ON BEHALF OF MY PERSONAL REPRESENTATIVES, SUCCESSORS, HEIRS, AND ASSIGNS, I DO HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, DEFEND, AND INDEMNIFY WHITE WATER CLASSIC, LTD., IT'S
OWNERS, AGENTS, OFFICERS, ANO EMPLOYEES FROM ANY ANOD ALL CLAIMS, ACTIONS, OR LOSSES FOR BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, LOSS OF SERVICES, OR OTHERWISE WHICH MAY ARISE FROM MY PARTICIPATiON IN THE ACTIVITIES IN WHICH I
WILL ENGAGE IN REGARD TO THE WHITEWATER RAFTING TRIP DESIGNATED ON THE OTHER SIDE OF THIS DOCUMENT. I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING, AND WAIVING, ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR
IN THE FUTURE FOR THE NEGLIGENT ACTS OR OTHER CONDUCT BY THE OWNERS, AGENTS, OFFICERS, OR EMPLOYEES OR WHITE WATER CLASSIC, LTD.</p>
<p>I HAVE READ THE FOREGOING ASSUMPTION OF RISK AND WAVER AND RELEASE OF LIABiLITY, AND BY SIGNING THIS DOCUMENT, AGREE THAT IT IS MY INTENTION TO EXCEPT AND RELIEVE WHITE WATER CLASSIC, LTD., ITS OWNERS, AGENTS, OFFICERS, AND EMPLOYEES
FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. BY SIGNING THIS DOCUMENT, I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ BOTH SIDES OF SAME AND THAT I UNDERSTAND ALL THE
TERMS AND CONDITIONS HEREOF, INCLUDING THE ASSUMPTION OF RISK AND WAIVER AND RELEASE OF LIABILITY.</p>,<p><strong>Lower Yough (Class III Waiver)</strong>:</p>
<p>OHIOPYLE TRADING POST, INC.</p>
<p>WAIVER AND RELEASE OF LIABILITY - READ CAREFULLY</p>
<p>In consideration of OHIOPYLE TRADING POST, INC. furnishing services and/or</p>
<p>equipment to enable me to participate in WHITEWATER RAFTING, I agree as follows:</p>
<p>I fully understand and acknowledge:</p>
<p>(a) that outdoor recreational activities are subject to inherent risks, dangers, and hazards, and that such exist in my sue of OHIOPYLE TRADING POST, INC. equipment and my participation in WHITEWATER RAFTING activities;</p>
<p>(b) that my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to, bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other
ailments that could cause serious disability;</p>
<p>(c) that these risks and dangers may be caused by the negligence of the owner, employees, officers, or agents of OHIOPYLE TRADING POST, INC., the negligence of the participants, the negligence of others, accidents, breaches of
contract, the forces of nature or the other causes;</p>
<p>(d) that risks and dangers may arise from foreseeable causes including, but not limited to, guided decision making, including that a guide may misjudge terrain, weather, trail or river route location, and water level;</p>
<p>(e) that risks of falling our of or drowning while in or out of a raft, canoe or kayak exist;</p>
<p>(f) that such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment exist; and</p>
<p>(g) that I am subject to all of said risks by my participation in said activities and/or my use of said equipment.</p>
<p>I hereby assume all the risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents officers, or employees or OHIOPYLE TRADING
POST, INC., or by any other person. I, on behalf of myself, my personal representatives and my heirs hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify OHIOPYLE TRADING POST, INC. and it’s
owners agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of service or otherwise, which may arise out of my use of OHIOPYLE TRADING</p>
<p>POST, INC. equipment or my participation in WHITEWATER RAFTING activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent
actIons or other conduct by the owners, agents, officers, or employees of OHIOPYLE TRADING POST, INC.</p>
<p>***THIS IS NOT A FLOAT TRIP***</p>
<p>The venue of any dispute that may arise out of this agreement or otherwise between or among parties that include OHIOPYLE TRADING POST, INC. or its agents shall be in a Magistrate’s Office located in Fayette County, Pennsylvania, or
in the Court of Common Pleas of Fayette County, Pennsylvania.</p>
<p>I consent to OHIOPYLE TRADING POST, INC. having reserved the right to use any all photos and videos of me and/or my group for promotional purposes, and agree that I shall not be compensated for its use thereof.</p>
<p>I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE THAT IT IS MY INTENTION TO EXEMPT AND RELIEVE OHIOPYLE TRADING POST, INC. FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR
ANY OTHER CAUSE.</p>,<p><strong>Middle Yough (Class I/II) Waiver</strong>:</p>
<p>OHIOPYLE TRADING POST, INC.</p>
<p>WAIVER AND RELEASE OF LIABILITY - READ CAREFULLY</p>
<p>In consideration of OHIOPYLE TRADING POST, INC. furnishing services and/or</p>
<p>equipment to enable me to participate in WHITEWATER RAFTING, I agree as follows:</p>
<p>I fully understand and acknowledge:</p>
<p>(a) that outdoor recreational activities are subject to inherent risks, dangers, and hazards, and that such exist in my sue of OHIOPYLE TRADING POST, INC. equipment and my participation in WHITEWATER RAFTING activities;</p>
<p>(b) that my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to, bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other

NEGLIGENCE OR ANY OTHER CAUSE.</p>,<p><strong>Water Craft Rental Agreement</strong>:</p>
<p>TERMS AND CONDITIONS</p>
<p>Lessee(s) agree(s) to return the Property to Lessor in the same condition as received (except for normal wear and tear incurred through normal usage) or pay for damage, losses, theft, or repairs necessary to restore the Property to
the same condition as when initially rented.</p>
<p>All Property lost or damaged beyond repair will be paid for by the Lessee(s) at the regular replacement cost of same.</p>
<p>Lessor agrees to release Lessee(s) from liability for Water Craft incurred in the ordinary use of same. However, this release does not apply to liability for loss or damage to paddle, life vests, and other accessories.</p>
<p>Lessee(s) agree that he/she/they will not permit any person to occupy or use the Property who is not a signatory to this Rental Agreement.</p>
<p>No refunds will be made or credit on rental charges given after Property has been taken out of Lessor’s place of business, regardless of weather or other conditions.</p>
<p>All Property must be returned to Lessor’s business establishment before 7:00 PM prevailing time, on the date of this Rental Agreement. A late charge $40.00 per hour or part thereof will be assessed for a late return. A late charge
equal to a full day’s rental will be assessed if the Property is not returned on the date of this Rental Agreement before Lessor’s place of business closes for the day.</p>
<p>A charge of $50.00 will be assessed if Lessor is required to pick up any Water Craft at a location other than Lessor’s place of business.</p>
<p>READ CAREFULLY THE FOLLOWING WAIVER AND RELEASE OF LIABILITY:</p>
<p>HAVING RECEIVED A SAFETY TALK BY A MEMBER OF LESSOR’S STAFF, AND HAVING READ THE SAFETY PRECAUTIONS AND RECOMMENDATIONS ON THE REVERSE SIDE HEREOF, LESSEE(S) HEREBY ACKNOWLEDGE THAT HE/SHE/THEY FULLY UNDERSTAND(S):</p>
<p>(a) THAT OUTDOOR RECREATIONAL ACTIVITIES HAVE INHERENT RISKS, DANGERS AND HAZARDS, AND THAT SUCH EXISTS IN MY USE OF THE EQUIPMENT ABOVE DESCRIBED AND MY PARTICIPATION IN WHITE WATER RAFTING AND RELATED ACTIVITIES;</p>
<p>(b) THAT MY PARTICIPATION IN SUCH ACTIVITIES AND/OR THE USE OF SUCH EQUIPMENT MAY RESULT IN INJURY OR ILLNESS, INCLUDING, BUT NOT LIMITED TO, BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL AND OR TOTAL PARALYSIS, DEATH, OR OTHER
AILMENTS THAT COULD CAUSE SERIOUS DISABILITY;</p>
<p>(c) THAT SAID RISKS AND DANGERS MAY BE CAUSED BY</p>
<p>(i) THE NEGLIGENCE OF THE OWNERS, EMPLOYEES, OFFICERS, OR AGENTS OF LESSOR,</p>
<p>(ii) THE NEGLIGENCE OF PARTICIPANTS,</p>
<p>(iii) THE NEGLIGENCE OF OTHERS,</p>
<p>(iv) ACCIDENTS, (v) BREACHES OF CONTRACT, AND</p>
<p>(vi) THE FORCES OF NATURE OR OTHER CAUSES;</p>
<p>(d) THAT RISKS AND DANGERS MAY ARISE FROM FORESEEABLE OR UNFORESEEABLE CAUSES, INCLUDING, BUT NOT LIMITED TO, GUIDE DECISION MAKING, INCLUDING THAT A GUIDE MAY MISJUDGE TERRAIN, WEATHER, TRAIL OR RIVER ROUTE LOCATION; WATER LEVEL;
FALLING OUT OF OR DROWNING WHILE IN A RAFT, CANOE, OR KAYAK; AND SUCH OTHER RISKS, HAZARDS, AND DANGERS THAT ARE INTEGRAL TO RECREATIONAL ACTIVITIES THAT TAKE PLACE IN A WILDERNESS, OUTDOOR OR RECREATIONAL ENVIRONMENT; AND</p>
<p>(e) THAT BY MY PARTICIPATION IN THESE ACTIVITIES AND/OR USE OF THE EQUIPMENT ABOVE DESCRIBED, I HEREBY ASSUME ALL RISKS, DANGERS, AND RESPONSIBILITY FOR ANY LOSSES AND/OR DANGERS, WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE
OR OTHER CONDUCT OF THE OWNERS, AGENTS OR EMPLOYEES OF LESSOR OR ANY OTHER PERSON. AND FURTHER, ON BEHALF OF MY PERSONAL EPRESENTATIVES, SUCCESSORS, HEIRS AND ASSIGNS, I DO HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD
HARMLESS, DEFEND, AND INDEMNIFY LESSOR AND ITS OWNERS, AGENTS, OFFICERS, AND EMPLOYEES FROM ANY AND ALL CLAIMS, ACTIONS, OR LOSSES FOR BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, LOSS OF SERVICES, OR OTHERWISE WHICH MAY ARISE OUT
OF MY USE OF THE EQUIPMENT ABOVE DESCRIBED, OR MY PARTICIPATION IN ANY ACTIVITIES INVOLVING SAID EQUIPMENT.</p>
<p>I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING, AND WAIVING ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR OTHER CONDUCT BY THE OWNERS, AGENTS, OFFICERS, OR EMPLOYEES OF LESSOR.
</p>
<p>I HAVE READ THE ABOVE WAIVER AND RELEASE, AND, BY SIGNING THIS RENTAL AGREEMENT, AGREE THAT IT IS MY INTENTION TO EXEMPT AND RELIEVE LESSOR AND ITS OWNERS, AGENTS, OFFICERS, AND EMPLOYEES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY
DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.</p>
<p>THE UNDERSIGNED LESSEE(S) HAVE RECEIVED AND READ THE OHIOPYLE TRADING POST, INC. “WAIVER” CONTAINING ALL INFORMATION RELATING TO THE HAZARDOUS NATURE OF WHITE WATER RAFTING ON THE YOUGHIOGHENY RIVER. THE UNDERSIGNED HAVE FURTHER BEEN
ADVISED THAT THERE ARE GUIDED TOURS AVAILABLE WITH EXPERIENCED GUIDES AND WITH THAT KNOWLEDGE HAVE CHOSEN TO PROCEED ON THEIR OWN WITHOUT THE ASSISTANCE OF THE GUIDE. THE UNDERSIGNED ASSUMES ALL RISKS RELATIVE TO THE USE OF THE RENTAL
EQUIPMENT.</p>
<p>Lessee(s) agree(s) and affirm(s) that Lessor has made no representation or warranty of any kind, nature, or description, express or implied, with respect to the Property or the condition of the river, and Lessee(s) affirm(s) that
he/she/they has/have not relied upon Lessor’s skill of judgement with respect to the use of the Property.</p>
<p>This Rental Agreement shall be legally binding upon the lessee(s) and his/her/their heirs, personal representatives, successors, and assigns, who hereby assume full responsibility for any unauthorized occupant and/or user of the
Property.</p>
<p>If there is more than one lessee signatory to this rental agreement, the contractual and other liability of the Lessees hereunder shall be joint and several.</p>

<p><strong>SAFETY PRECAUTIONS</strong></p>
<p>All persons using the rented Property should be able to swim. Non swimmers should not use Water Craft.</p>
<p>Wear your life vest at all times.</p>
<p>Drugs and excessive use of alcoholic beverages prohibited.</p>
<p>Have appropriate clothing for weather conditions, sun protection, food, and beverages.</p>
<p>Wear sneakers or river shoes to avoid cuts or foot injuries. Do not go barefoot.</p>
<p>Be aware of sudden drop-offs and strong currents. Do not over estimate your abilities.</p>
<p>If you capsize, attempt to stay upstream of the Water Craft and keep your feet to the surface of the water.</p>
<p>Pay attention to the safety talk given by our staff and the video safety talk given by the State Park Service at the launch point of your Water Craft.</p>
<p>No more than five (5) persons are permitted to occupy a four-man Water Craft at one time.</p>
<p><strong>RECOMMENDATIONS</strong></p>
<p>Check your Rental Agreement for accuracy of the description of the Water Craft issued to you.</p>
<p>Check the condition of the Water Craft issued to you when you receive it.</p>
<p>Do not carry glass containers with you while occupying the Water Craft or at any other time.</p>
<p>Dispose of refuse and litter in receptacles provided at various places in the State Park.</p>
<p>Respect private property and be courteous to others.</p>
<p>Do not leave the Property unattended.</p>
<p>Camp only in authorized areas.</p>
<p>Obey all Park Service rules and regulations.</p>
<p>Secure the Water Craft away from the water’s edge in case the river rises.</p>
<p>When and where fires are permitted, keep them small and in proper areas only.</p>
<p>Use only dead and down wood for camp fires.</p>
<p>Do not cut, carve, or disturb live trees in any way.</p>
<p>At the end of your trip, empty your Water Craft as soon as possible by removing all garbage, strings, gear and other possessions.</p>,<p><strong>Water Craft Rental Agreement</strong>:</p>
<p>TERMS AND CONDITIONS</p>
<p>Lessee(s) agree(s) to return the Property to Lessor in the same condition as received (except for normal wear and tear incurred through normal usage) or pay for damage, losses, theft, or repairs necessary to restore the Property to
the same condition as when initially rented.</p>
<p>All Property lost or damaged beyond repair will be paid for by the Lessee(s) at the regular replacement cost of same.</p>
<p>Lessor agrees to release Lessee(s) from liability for Water Craft incurred in the ordinary use of same. However, this release does not apply to liability for loss or damage to paddle, life vests, and other accessories.</p>
<p>Lessee(s) agree that he/she/they will not permit any person to occupy or use the Property who is not a signatory to this Rental Agreement.</p>
<p>No refunds will be made or credit on rental charges given after Property has been taken out of Lessor’s place of business, regardless of weather or other conditions.</p>
<p>All Property must be returned to Lessor’s business establishment before 7:00 PM prevailing time, on the date of this Rental Agreement. A late charge $40.00 per hour or part thereof will be assessed for a late return. A late charge
equal to a full day’s rental will be assessed if the Property is not returned on the date of this Rental Agreement before Lessor’s place of business closes for the day.</p>
<p>A charge of $50.00 will be assessed if Lessor is required to pick up any Water Craft at a location other than Lessor’s place of business.</p>
<p>READ CAREFULLY THE FOLLOWING WAIVER AND RELEASE OF LIABILITY:</p>
<p>HAVING RECEIVED A SAFETY TALK BY A MEMBER OF LESSOR’S STAFF, AND HAVING READ THE SAFETY PRECAUTIONS AND RECOMMENDATIONS ON THE REVERSE SIDE HEREOF, LESSEE(S) HEREBY ACKNOWLEDGE THAT HE/SHE/THEY FULLY UNDERSTAND(S):</p>
<p>(a) THAT OUTDOOR RECREATIONAL ACTIVITIES HAVE INHERENT RISKS, DANGERS AND HAZARDS, AND THAT SUCH EXISTS IN MY USE OF THE EQUIPMENT ABOVE DESCRIBED AND MY PARTICIPATION IN WHITE WATER RAFTING AND RELATED ACTIVITIES;</p>
<p>(b) THAT MY PARTICIPATION IN SUCH ACTIVITIES AND/OR THE USE OF SUCH EQUIPMENT MAY RESULT IN INJURY OR ILLNESS, INCLUDING, BUT NOT LIMITED TO, BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL AND OR TOTAL PARALYSIS, DEATH, OR OTHER
AILMENTS THAT COULD CAUSE SERIOUS DISABILITY;</p>
<p>(c) THAT SAID RISKS AND DANGERS MAY BE CAUSED BY</p>
<p>(i) THE NEGLIGENCE OF THE OWNERS, EMPLOYEES, OFFICERS, OR AGENTS OF LESSOR,</p>
<p>(ii) THE NEGLIGENCE OF PARTICIPANTS,</p>
<p>(iii) THE NEGLIGENCE OF OTHERS,</p>
<p>(iv) ACCIDENTS, (v) BREACHES OF CONTRACT, AND</p>
<p>(vi) THE FORCES OF NATURE OR OTHER CAUSES;</p>
<p>(d) THAT RISKS AND DANGERS MAY ARISE FROM FORESEEABLE OR UNFORESEEABLE CAUSES, INCLUDING, BUT NOT LIMITED TO, GUIDE DECISION MAKING, INCLUDING THAT A GUIDE MAY MISJUDGE TERRAIN, WEATHER, TRAIL OR RIVER ROUTE LOCATION; WATER LEVEL;
FALLING OUT OF OR DROWNING WHILE IN A RAFT, CANOE, OR KAYAK; AND SUCH OTHER RISKS, HAZARDS, AND DANGERS THAT ARE INTEGRAL TO RECREATIONAL ACTIVITIES THAT TAKE PLACE IN A WILDERNESS, OUTDOOR OR RECREATIONAL ENVIRONMENT; AND</p>
<p>(e) THAT BY MY PARTICIPATION IN THESE ACTIVITIES AND/OR USE OF THE EQUIPMENT ABOVE DESCRIBED, I HEREBY ASSUME ALL RISKS, DANGERS, AND RESPONSIBILITY FOR ANY LOSSES AND/OR DANGERS, WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE
OR OTHER CONDUCT OF THE OWNERS, AGENTS OR EMPLOYEES OF LESSOR OR ANY OTHER PERSON. AND FURTHER, ON BEHALF OF MY PERSONAL EPRESENTATIVES, SUCCESSORS, HEIRS AND ASSIGNS, I DO HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD
HARMLESS, DEFEND, AND INDEMNIFY LESSOR AND ITS OWNERS, AGENTS, OFFICERS, AND EMPLOYEES FROM ANY AND ALL CLAIMS, ACTIONS, OR LOSSES FOR BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, LOSS OF SERVICES, OR OTHERWISE WHICH MAY ARISE OUT
OF MY USE OF THE EQUIPMENT ABOVE DESCRIBED, OR MY PARTICIPATION IN ANY ACTIVITIES INVOLVING SAID EQUIPMENT.</p>
<p>I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING, AND WAIVING ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR OTHER CONDUCT BY THE OWNERS, AGENTS, OFFICERS, OR EMPLOYEES OF LESSOR.

DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.</p>
<p>THE UNDERSIGNED LESSEE(S) HAVE RECEIVED AND READ THE OHIOPYLE TRADING POST, INC. “WAIVER” CONTAINING ALL INFORMATION RELATING TO THE HAZARDOUS NATURE OF WHITE WATER RAFTING ON THE YOUGHIOGHENY RIVER. THE UNDERSIGNED HAVE FURTHER BEEN
ADVISED THAT THERE ARE GUIDED TOURS AVAILABLE WITH EXPERIENCED GUIDES AND WITH THAT KNOWLEDGE HAVE CHOSEN TO PROCEED ON THEIR OWN WITHOUT THE ASSISTANCE OF THE GUIDE. THE UNDERSIGNED ASSUMES ALL RISKS RELATIVE TO THE USE OF THE RENTAL
EQUIPMENT.</p>
<p>Lessee(s) agree(s) and affirm(s) that Lessor has made no representation or warranty of any kind, nature, or description, express or implied, with respect to the Property or the condition of the river, and Lessee(s) affirm(s) that
he/she/they has/have not relied upon Lessor’s skill of judgement with respect to the use of the Property.</p>
<p>This Rental Agreement shall be legally binding upon the lessee(s) and his/her/their heirs, personal representatives, successors, and assigns, who hereby assume full responsibility for any unauthorized occupant and/or user of the
Property.</p>

<p>I, the undersigned, do hereby accept for rental the equipment below described and acknowledge that it is in good working condition. I further agree to use said equipment in a careful and prudent manner; to return it in the same
condition as received (except for normal wear and tear incurred through normal usage); to pay for damage, loss, theft, or repairs necessary to restore the equipment to the same condition as when received; to pay the regular
replacement cost of the equipment if it is lost or damaged beyond repair; and not to loan or in any manner dispose of the equipment without the written consent of Ohiopyle Trading Post, Inc.</p>
<p>READ CAREFULLY THE FOLLOWING WAIVER AND RELEASE OF LIABILITY</p>

<p>(a) THAT OUTDOOR RECREATIONAL ACTIVITIES HAVE INHERENT RISKS, DAN, GERS. AND HAZARDS. AND THAT SUCH EXISTS IN MY USE OF THE EQUIPMENT BELOW DESCRIBED AND MY PARTICIPATION IN ALL BICYCLE RIDING ACTIVITIES;</p>
<p>(b) THAT MY PARTICIPATION IN SUCH ACTIVITIES AND/OR THE USE OF SUCH EQUIPMENT MAY RESULT IN INJURY OR ILLNESS, INCLUDING. BUT NOT LIMITED TO, BODrLY INJURY, DISEASE. STRAINS. FRAC, TURES. PARTIAL AND/OR TOTAL PARALYSIS, DEATH,
OR OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY;</p>
<p>(c) THAT SAID RISKS AND DANGERS MAY BE CAUSED BY</p>
<p>(i) THE NEGLIGENCE OF THE OWNERS. EMPLOYEES, OFFICERS, OR AGENTS OF OHIOPYLE TRADING POST, INC.;</p>
<p>(ii) THE NEGLIGENCE OF PARTICIPANTS.</p>
<p>(iii) THE NEGLIGENCE OF OTHERS</p>
<p>(iv)ACCIDENTS,</p>
<p>(v) BREACHES OF CONTRACT. AND</p>

<p>(d) THAT ALL OF SAID RISKS AND DANGERS MAY ARISE FROM FORESEEABLE OR UNFORESEEABLE CAUSES. INCLUDING, BUT NOT LIMtTED TO WEATHER AND SUCH OTHER RISKS. HAZARDS. AND DANGERS THAT ARE INTEGRAL TO RECREATIONAL ACTIVITIES
THAT TAKE PLACE IN A WILDERNESS OR OUTDOOR OR RECREATIONAL ENVIRONMENT; AND (e) THAT BY MY PARTICIPATION IN THESE ACTIVITIES AND/OR USE OF THE EQUIPMENT BELOW DESCRIBED. I HEREBY ASSUME ALL RISKS. DANGERS.
AND RESPONSIBILITY FOR ANY LOSSES AND/OR DAMAGES. WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OR OTHER CONDUCT OF THE OWNERS. AGENTS. OR EMPLOYEES OF OHIOPYLE TRADING POST,INC., OR ANY OTHER PERSON. AND

OR OTHER CONDUCT OF THE OWNERS, AGENTS OR EMPLOYEES OF LESSOR OR ANY OTHER PERSON. AND FURTHER, ON BEHALF OF MY PERSONAL EPRESENTATIVES, SUCCESSORS, HEIRS AND ASSIGNS, I DO HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD

OF MY USE OF THE EQUIPMENT ABOVE DESCRIBED, OR MY PARTICIPATION IN ANY ACTIVITIES INVOLVING SAID EQUIPMENT.</p>

<p>Lessee(s) agree(s) and affirm(s) that Lessor has made no representation or warranty of any kind, nature, or description, express or implied, with respect to the Property or the condition of the river, and Lessee(s) affirm(s) that
he/she/they has/have not relied upon Lessor’s skill of judgement with respect to the use of the Property.</p>
<p>This Rental Agreement shall be legally binding upon the lessee(s) and his/her/their heirs, personal representatives, successors, and assigns, who hereby assume full responsibility for any unauthorized occupant and/or user of the
Property.</p>
<p>If there is more than one lessee signatory to this rental agreement, the contractual and other liability of the Lessees hereunder shall be joint and several.</p>
<p>IN WITNESS WHEREOF, and intending to be legally bound hereby, the undersigned Lessee(s) hereby certify that he/she/they have read and understood the terms and conditions of this Rental Agreement, and has/have affixed his/her/their
hand(s) and seal(s) hereto on the dates indicated.</p>
<p><strong>SAFETY PRECAUTIONS</strong></p>
<p>All persons using the rented Property should be able to swim. Non swimmers should not use Water Craft.</p>
<p>Wear your life vest at all times.</p>
<p>Drugs and excessive use of alcoholic beverages prohibited.</p>
<p>Have appropriate clothing for weather conditions, sun protection, food, and beverages.</p>
<p>Wear sneakers or river shoes to avoid cuts or foot injuries. Do not go barefoot.</p>
<p>Be aware of sudden drop-offs and strong currents. Do not over estimate your abilities.</p>
<p>If you capsize, attempt to stay upstream of the Water Craft and keep your feet to the surface of the water.</p>
<p>Pay attention to the safety talk given by our staff and the video safety talk given by the State Park Service at the launch point of your Water Craft.</p>
<p>No more than five (5) persons are permitted to occupy a four-man Water Craft at one time.</p>
<p><strong>RECOMMENDATIONS</strong></p>
<p>Check your Rental Agreement for accuracy of the description of the Water Craft issued to you.</p>
<p>Check the condition of the Water Craft issued to you when you receive it.</p>
<p>Do not carry glass containers with you while occupying the Water Craft or at any other time.</p>
<p>Dispose of refuse and litter in receptacles provided at various places in the State Park.</p>
<p>Respect private property and be courteous to others.</p>
<p>Do not leave the Property unattended.</p>
<p>Camp only in authorized areas.</p>
<p>Obey all Park Service rules and regulations.</p>
<p>Secure the Water Craft away from the water’s edge in case the river rises.</p>
<p>When and where fires are permitted, keep them small and in proper areas only.</p>
<p>Use only dead and down wood for camp fires.</p>
<p>Do not cut, carve, or disturb live trees in any way.</p>
<p>At the end of your trip, empty your Water Craft as soon as possible by removing all garbage, strings, gear and other possessions.</p>

I hereby acknowledge that I have received a safety talk by a member of the staff of While Water Classic, Ltd" and have read fully and understand the following notices, warnings, safety precautions, and recommendations: (a) THE YOUGHIOGHENY HAS BEEN DESIGNATED AS A ClASS V RIVER WHICH IS DEFINED AS HAVING EXTREMELY DIFFICULT LONG, AND VERY VIOLENT RAPIDS WITH HIGHLY CONGESTED ROUTES. (b) RESCUE CONDITIONS ARE DIFFICULT. (c) THEBE IS A SIGNIFICANT HAZARD TO LIFE IN THE EVENT OF A MISHAP. (d) A PARTICIPANT IN THE EVENT OF WHITEWATER RAFTING SHOULD HAVE PREVIOUS EXPERIENCE BEFORE PARTICIPATING IN A COMMERCIAl WHITEWATER TRIP ON THE YOUGHIOGHENY WILD RIVER. (e) OUTDOOR RECREATIONAL ACTIVlTIES HAVE INHERENT RISKS, DAN.GERS, AND HAZARDS, AND SUCH EXIST IN THE USE OF THE PROPERTY AND EQUIPMENT NEEDED FOR WHITEWATER RAFTING AND RELATED ACTIVITIES. (f) PARTICIPATION IN WHITEWATER RAFTING AND THE USE OF THE PROPERTY AND EQUIPMENT REQUIRED THEREFORE MAY RESULT IN INJURY AND/OR ILLNESS, INCLUDING, BUT NOT LIMITED TO BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL OR TOTAL PARALYSIS, DEATH, OR OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY. BY SIGNING THIS DOCUMENT, I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ BOTH SIDES OF SAME AND THAT I UNDERSTAND ALL THE TERMS AND CONDITIONS HEREOF, INCLUDING THE ASSUMPTION OF RISK AND WAIVER AND RELEASE OF LIABILITY. , Lower Yough (Class III Waiver): OHIOPYLE TRADING POST, INC. WAIVER AND RELEASE OF LIABILITY - READ CAREFULLY In consideration of OHIOPYLE TRADING POST, INC. furnishing services and/or equipment to enable me to participate in WHITEWATER RAFTING, I agree as follows: I fully understand and acknowledge: (a) that outdoor recreational activities are subject to inherent risks, dangers, and hazards, and that such exist in my sue of OHIOPYLE TRADING POST, INC. equipment and my participation in WHITEWATER RAFTING activities; (b) that my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to, bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) that these risks and dangers may be caused by the negligence of the owner, employees, officers, or agents of OHIOPYLE TRADING POST, INC., the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or the other causes; (d) that risks and dangers may arise from foreseeable causes including, but not limited to, guided decision making, including that a guide may misjudge terrain, weather, trail or river route location, and water level; (e) that risks of falling our of or drowning while in or out of a raft, canoe or kayak exist; (f) that such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment exist; and (g) that I am subject to all of said risks by my participation in said activities and/or my use of said equipment. I hereby assume all the risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents officers, or employees or OHIOPYLE TRADING POST, INC., or by any other person. I, on behalf of myself, my personal representatives and my heirs hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify OHIOPYLE TRADING POST, INC. and it’s owners agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of service or otherwise, which may arise out of my use of OHIOPYLE TRADING POST, INC. equipment or my participation in WHITEWATER RAFTING activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent actIons or other conduct by the owners, agents, officers, or employees of OHIOPYLE TRADING POST, INC. ***THIS IS NOT A FLOAT TRIP*** The venue of any dispute that may arise out of this agreement or otherwise between or among parties that include OHIOPYLE TRADING POST, INC. or its agents shall be in a Magistrate’s Office located in Fayette County, Pennsylvania, or in the Court of Common Pleas of Fayette County, Pennsylvania. I consent to OHIOPYLE TRADING POST, INC. having reserved the right to use any all photos and videos of me and/or my group for promotional purposes, and agree that I shall not be compensated for its use thereof. All Property lost or damaged beyond repair will be paid for by the Lessee(s) at the regular replacement cost of same. Lessor agrees to release Lessee(s) from liability for Water Craft incurred in the ordinary use of same. However, this release does not apply to liability for loss or damage to paddle, life vests, and other accessories. Lessee(s) agree that he/she/they will not permit any person to occupy or use the Property who is not a signatory to this Rental Agreement. No refunds will be made or credit on rental charges given after Property has been taken out of Lessor’s place of business, regardless of weather or other conditions. All Property must be returned to Lessor’s business establishment before 7:00 PM prevailing time, on the date of this Rental Agreement. A late charge $40.00 per hour or part thereof will be assessed for a late return. A late charge equal to a full day’s rental will be assessed if the Property is not returned on the date of this Rental Agreement before Lessor’s place of business closes for the day. A charge of $50.00 will be assessed if Lessor is required to pick up any Water Craft at a location other than Lessor’s place of business. READ CAREFULLY THE FOLLOWING WAIVER AND RELEASE OF LIABILITY: HAVING RECEIVED A SAFETY TALK BY A MEMBER OF LESSOR’S STAFF, AND HAVING READ THE SAFETY PRECAUTIONS AND RECOMMENDATIONS ON THE REVERSE SIDE HEREOF, LESSEE(S) HEREBY ACKNOWLEDGE THAT HE/SHE/THEY FULLY UNDERSTAND(S): (a) THAT OUTDOOR RECREATIONAL ACTIVITIES HAVE INHERENT RISKS, DANGERS AND HAZARDS, AND THAT SUCH EXISTS IN MY USE OF THE EQUIPMENT ABOVE DESCRIBED AND MY PARTICIPATION IN WHITE WATER RAFTING AND RELATED ACTIVITIES; (b) THAT MY PARTICIPATION IN SUCH ACTIVITIES AND/OR THE USE OF SUCH EQUIPMENT MAY RESULT IN INJURY OR ILLNESS, INCLUDING, BUT NOT LIMITED TO, BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL AND OR TOTAL PARALYSIS, DEATH, OR OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY; (c) THAT SAID RISKS AND DANGERS MAY BE CAUSED BY (i) THE NEGLIGENCE OF THE OWNERS, EMPLOYEES, OFFICERS, OR AGENTS OF LESSOR, (ii) THE NEGLIGENCE OF PARTICIPANTS, (iii) THE NEGLIGENCE OF OTHERS, (iv) ACCIDENTS, (v) BREACHES OF CONTRACT, AND (vi) THE FORCES OF NATURE OR OTHER CAUSES; (d) THAT RISKS AND DANGERS MAY ARISE FROM FORESEEABLE OR UNFORESEEABLE CAUSES, INCLUDING, BUT NOT LIMITED TO, GUIDE DECISION MAKING, INCLUDING THAT A GUIDE MAY MISJUDGE TERRAIN, WEATHER, TRAIL OR RIVER ROUTE LOCATION; WATER LEVEL; FALLING OUT OF OR DROWNING WHILE IN A RAFT, CANOE, OR KAYAK; AND SUCH OTHER RISKS, HAZARDS, AND DANGERS THAT ARE INTEGRAL TO RECREATIONAL ACTIVITIES THAT TAKE PLACE IN A WILDERNESS, OUTDOOR OR RECREATIONAL ENVIRONMENT; AND (e) THAT BY MY PARTICIPATION IN THESE ACTIVITIES AND/OR USE OF THE EQUIPMENT ABOVE DESCRIBED, I HEREBY ASSUME ALL RISKS, DANGERS, AND RESPONSIBILITY FOR ANY LOSSES AND/OR DANGERS, WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OR OTHER CONDUCT OF THE OWNERS, AGENTS OR EMPLOYEES OF LESSOR OR ANY OTHER PERSON. AND FURTHER, ON BEHALF OF MY PERSONAL EPRESENTATIVES, SUCCESSORS, HEIRS AND ASSIGNS, I DO HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, DEFEND, AND INDEMNIFY LESSOR AND ITS OWNERS, AGENTS, OFFICERS, AND EMPLOYEES FROM ANY AND ALL CLAIMS, ACTIONS, OR LOSSES FOR BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, LOSS OF SERVICES, OR OTHERWISE WHICH MAY ARISE OUT OF MY USE OF THE EQUIPMENT ABOVE DESCRIBED, OR MY PARTICIPATION IN ANY ACTIVITIES INVOLVING SAID EQUIPMENT. I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING, AND WAIVING ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR OTHER CONDUCT BY THE OWNERS, AGENTS, OFFICERS, OR EMPLOYEES OF LESSOR. I HAVE READ THE ABOVE WAIVER AND RELEASE, AND, BY SIGNING THIS RENTAL AGREEMENT, AGREE THAT IT IS MY INTENTION TO EXEMPT AND RELIEVE LESSOR AND ITS OWNERS, AGENTS, OFFICERS, AND EMPLOYEES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. THE UNDERSIGNED LESSEE(S) HAVE RECEIVED AND READ THE OHIOPYLE TRADING POST, INC. “WAIVER” CONTAINING ALL INFORMATION RELATING TO THE HAZARDOUS NATURE OF WHITE WATER RAFTING ON THE YOUGHIOGHENY RIVER. THE UNDERSIGNED HAVE FURTHER BEEN ADVISED THAT THERE ARE GUIDED TOURS AVAILABLE WITH EXPERIENCED GUIDES AND WITH THAT KNOWLEDGE HAVE CHOSEN TO PROCEED ON THEIR OWN WITHOUT THE ASSISTANCE OF THE GUIDE. THE UNDERSIGNED ASSUMES ALL RISKS RELATIVE TO THE USE OF THE RENTAL EQUIPMENT. Lessee(s) agree(s) and affirm(s) that Lessor has made no representation or warranty of any kind, nature, or description, express or implied, with respect to the Property or the condition of the river, and Lessee(s) affirm(s) that he/she/they has/have not relied upon Lessor’s skill of judgement with respect to the use of the Property. This Rental Agreement shall be legally binding upon the lessee(s) and his/her/their heirs, personal representatives, successors, and assigns, who hereby assume full responsibility for any unauthorized occupant and/or user of the Property. If there is more than one lessee signatory to this rental agreement, the contractual and other liability of the Lessees hereunder shall be joint and several. IN WITNESS WHEREOF, and intending to be legally bound hereby, the undersigned Lessee(s) hereby certify that he/she/they have read and understood the terms and conditions of this Rental Agreement, and has/have affixed his/her/their hand(s) and seal(s) hereto on the dates indicated. SAFETY PRECAUTIONS All persons using the rented Property should be able to swim. Non swimmers should not use Water Craft. Wear your life vest at all times. Drugs and excessive use of alcoholic beverages prohibited. Have appropriate clothing for weather conditions, sun protection, food, and beverages. Wear sneakers or river shoes to avoid cuts or foot injuries. Do not go barefoot. Be aware of sudden drop-offs and strong currents. Do not over estimate your abilities. If you capsize, attempt to stay upstream of the Water Craft and keep your feet to the surface of the water. Pay attention to the safety talk given by our staff and the video safety talk given by the State Park Service at the launch point of your Water Craft. No more than five (5) persons are permitted to occupy a four-man Water Craft at one time. RECOMMENDATIONS Check your Rental Agreement for accuracy of the description of the Water Craft issued to you. Check the condition of the Water Craft issued to you when you receive it. Do not carry glass containers with you while occupying the Water Craft or at any other time. Dispose of refuse and litter in receptacles provided at various places in the State Park. Respect private property and be courteous to others. Do not leave the Property unattended. Camp only in authorized areas. Obey all Park Service rules and regulations. Secure the Water Craft away from the water’s edge in case the river rises. When and where fires are permitted, keep them small and in proper areas only. Use only dead and down wood for camp fires. Do not cut, carve, or disturb live trees in any way. I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING, AND WAIVING ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR OTHER CONDUCT BY THE OWNERS, AGENTS, OFFICERS, OR EMPLOYEES OF LESSOR. All Property lost or damaged beyond repair will be paid for by the Lessee(s) at the regular replacement cost of same. Lessor agrees to release Lessee(s) from liability for Water Craft incurred in the ordinary use of same. However, this release does not apply to liability for loss or damage to paddle, life vests, and other accessories. Lessee(s) agree that he/she/they will not permit any person to occupy or use the Property who is not a signatory to this Rental Agreement. No refunds will be made or credit on rental charges given after Property has been taken out of Lessor’s place of business, regardless of weather or other conditions. All Property must be returned to Lessor’s business establishment before 7:00 PM prevailing time, on the date of this Rental Agreement. A late charge $40.00 per hour or part thereof will be assessed for a late return. A late charge equal to a full day’s rental will be assessed if the Property is not returned on the date of this Rental Agreement before Lessor’s place of business closes for the day. A charge of $50.00 will be assessed if Lessor is required to pick up any Water Craft at a location other than Lessor’s place of business. THE UNDERSIGNED HAVE FURTHER BEEN ADVISED THAT THERE ARE GUIDED TOURS AVAILABLE WITH EXPERIENCED GUIDES AND WITH THAT KNOWLEDGE HAVE CHOSEN TO PROCEED ON THEIR OWN WITHOUT THE ASSISTANCE OF THE GUIDE. THE UNDERSIGNED ASSUMES ALL RISKS RELATIVE TO THE USE OF THE RENTAL EQUIPMENT. Lessee(s) agree(s) and affirm(s) that Lessor has made no representation or warranty of any kind, nature, or description, express or implied, with respect to the Property or the condition of the river, and Lessee(s) affirm(s) that he/she/they has/have not relied upon Lessor’s skill of judgement with respect to the use of the Property. This Rental Agreement shall be legally binding upon the lessee(s) and his/her/their heirs, personal representatives, successors, and assigns, who hereby assume full responsibility for any unauthorized occupant and/or user of the Property. If there is more than one lessee signatory to this rental agreement, the contractual and other liability of the Lessees hereunder shall be joint and several. IN WITNESS WHEREOF, and intending to be legally bound hereby, the undersigned Lessee(s) hereby certify that he/she/they have read and understood the terms and conditions of this Rental Agreement, and has/have affixed his/her/their hand(s) and seal(s) hereto on the dates indicated. SAFETY PRECAUTIONS All persons using the rented Property should be able to swim. Non swimmers should not use Water Craft. Wear your life vest at all times. Drugs and excessive use of alcoholic beverages prohibited. Have appropriate clothing for weather conditions, sun protection, food, and beverages. Wear sneakers or river shoes to avoid cuts or foot injuries. Do not go barefoot. Be aware of sudden drop-offs and strong currents. Do not over estimate your abilities. If you capsize, attempt to stay upstream of the Water Craft and keep your feet to the surface of the water. Pay attention to the safety talk given by our staff and the video safety talk given by the State Park Service at the launch point of your Water Craft. No more than five (5) persons are permitted to occupy a four-man Water Craft at one time. RECOMMENDATIONS Check your Rental Agreement for accuracy of the description of the Water Craft issued to you. Check the condition of the Water Craft issued to you when you receive it. Do not carry glass containers with you while occupying the Water Craft or at any other time. Dispose of refuse and litter in receptacles provided at various places in the State Park. Respect private property and be courteous to others. Do not leave the Property unattended. Camp only in authorized areas. Obey all Park Service rules and regulations. Secure the Water Craft away from the water’s edge in case the river rises.
