Objective Corporation Limited and its Affiliates (collectively, “Objective”,
“we”, “us” or “our”) respect your privacy and are committed to protecting your
Personal Information. 

This Privacy Policy sets out how Objective collects and uses your Personal
Information in making available the website at www.objective.com (plus any
related websites), our various software and cloud service solutions, and
associated services that we supply to our customers.

We may update this Privacy Policy from time to time to address changes in our
business operations and to comply with new laws and regulations. The most
current version is posted on our Website and will apply from the date stated in
the Privacy Policy. You may request a PDF copy of this Privacy Policy by
contacting us at our contact details in Section 17 below.

1. WHAT IS THE PURPOSE OF THIS PRIVACY POLICY?

We take our privacy obligations seriously. When you use our Website or use our
Services we may collect, use, share and process Personal Information about you,
and we may also collect your Personal Information offline. 

This Privacy Policy is intended to ensure that we are open and transparent about
how we collect, use and manage your Personal Information.

It will give you clarity about who we are, what Personal Information we collect,
why we collect it, how we use it, and your rights in connection with Personal
Information that we hold about you. 

This Privacy Policy is designed to meet our obligations under the privacy laws
of Australia (where our Head Office is located), New Zealand, the United
Kingdom, Singapore and the United States of America; which is where our offices
are located.

It is also designed to meet our transparency obligations under the European
Union’s General Data Protection Regulation (“GDPR”) and our disclosure
obligation as a “business” under the California Consumer Privacy Act (“CCPA”).
GDPR applies when we control or process personal data of EU individuals.
However, this Privacy Policy is not designed to address our status as a data
processor for some of our customers under GDPR or equivalent laws or as a
service provider under the CCPA. We set out our obligations for any such data
processing in a separate document called a Data Processing Addendum, which is
available on the ‘Legal’ page of our Website and upon request. 

You may contact us (using our contact details in Section 17 below) if you wish
to know which Affiliate is responsible as the data controller or processor of
your Personal Information for GDPR purposes.

In this Privacy Policy, the following terms have the meanings given to them
below: 

 * "Affiliates" means any affiliate of Objective Corporation Limited, wherever
   located in the world. A list of these Affiliates can be found at our ‘Legal’
   page on our Website, which may change from time to time;
 * “Objective”, “we”, “us” or “our” means:

 1. Objective Corporation Limited; and/or 
 2. any or all of its Affiliates,

as the context requires;

“Objective Corporation Limited” means the Australian company of that name, with
ABN 16 050 539 350 and its registered office at Level 30, 177 Pacific Hwy, North
Sydney, NSW, 2060, Australia;

 * “Personal Information” means information or data about identified or
   reasonably identifiable natural persons, or, if applicable, households.
   Wholly anonymous information is not covered. However, pseudonymous or
   indirect information may be covered if it could reasonably identify a natural
   person, or if applicable, household, when combined with other reasonably
   accessible information;
 * “Services” means our various software-as-a-service solutions, on-premise
   software solutions, and associated professional services, that we supply to
   our customers and offer to prospective customers; 
 * “User” means any person who uses our Website and/or our Services; 
 * “Website” means, collectively, our website at www.objective.com and any of
   our other ‘Objective’ websites with different country domain names
   (e.g. www.objective.co.uk); and
 * “you” or “your” means the person whose Personal Information may be collected
   and processed by us in accordance with this Privacy Policy.


3. WHAT PERSONAL INFORMATION DOES OBJECTIVE COLLECT AND FOR WHAT PURPOSE?

All Personal Information that we collect from you (or from third-parties) falls

with applicable law as we conduct our business and operations, so the purpose of
the collection of your Personal Information may also include ‘compliance with
law’. 


4. HOW DOES OBJECTIVE COLLECT PERSONAL INFORMATION?

Above you will have seen the different types of Personal Information that we
collect, and also the table setting out the reasons for our collection of
Personal Information. This section sets out more detail for you. 

We collect information relating to you and your use of our Website and our
Services from a variety of sources, but always do so fairly and only to the
extent permitted by law. Some of this information is collected directly from
you, some from your use of our Services and some from third-parties. We collect
Personal Information from you unless it is unreasonable or impractical to do so.

Personal Information we collect directly from you is the information that you
voluntarily supply to us, which may include:

 * your name and contact details when you contact us, subscribe to our Services
   or apply for a job; 
 * your account details including passwords, billing details such as credit card
   information, and personal account settings such as preferences or profiles
   (for example, preferred language or time zone); 
 * survey data (your answers to questions); and
 * information about the device you are using to access the Services and any
   other data that you directly submit to us, for example, by entering
   competitions or providing reviews. 

We only collect information that is reasonably necessary for our functions and
activities, including supplying you with the Services.

If you apply for a position with us, we may also collect your employment-related
information, employment history, education details, qualifications and other
publicly available information. We will generally collect the information from
you but may also collect information from employment agencies, your referees,
and your former employers and educational institutions.

Information we collect from other sources includes:

 * Data from third-parties, but only if those third-parties are lawfully
   permitted to share your information with us. 
 * Any external source, if you came to our Website via a link on another website
   or an email. We record information about the source that referred you to us.
 * Personal Information from social media sites, for example, if you send us a
   tweet on Twitter.
 * Usage data about what you do when you use our Website or access our Services.
   This may include which web pages you visit, what you click on and when. Our
   web servers also collect data from the device you use to access our Website
   or our Services, such as your IP address and possibly your location. The
   servers keep log files that record data each time a device accesses our
   servers. 

We use various technologies to obtain usage data, including:  

 * Cookies and similar commonly-used information gathering tools which are small
   files placed on the User’s hard-drive during a visit to a website to allow
   fast, easy and meaningful navigation around the site. These technologies may
   be used by us or our service providers to analyse and track how Users use our
   Websites. Standing alone, cookies do not identify you, they only recognise
   your browser. When you give us information, we can also send cookies to
   remember Users’ settings and preferences.  Objective uses both session-only
   and permanent cookies, often depending on whether the use is casual or a more
   complex interaction (such as by a subscriber to our Services). 
 * Local Storage, such as HTML5, to store user preferences. Third-parties who
   provide advertising on our Websites can personalise advertising based on your
   web browsing activity by using Flash cookies and HTML5 to collect and store
   information. We do not disclose your identity to advertisers, but the Flash
   cookies remember which browsers have visited the Websites. 
 * Web beacons, which are often used in marketing emails to notify Objective
   when you click on a link in the email that directs you to one of our
   Websites. 
 * Social media features, such as the Facebook “Like” button, which may collect
   your IP address, detect which page you are visiting on our Website, and set a
   cookie.  

You should be aware that your use of social media via our Websites or via links
to other websites is governed by the privacy policies of the third-parties who
operate those websites and not this Privacy Policy. We therefore recommend that
you read the privacy policy of any website you visit.   Objective does not
review, approve or make any representations or warranties in relation to the
privacy practices of any third-party website and we are not responsible for the
privacy policies or the content of any third-party website. 

Disabling cookies. You can typically remove or reject cookies via your browser
settings. In order to do this, follow the instructions provided by your browser
(usually located within the “settings”, “help”, “tools” or “edit” facility).
Many browsers are set to accept cookies until you change your settings. If you
do not accept our cookies, you may experience some inconvenience in your use of
our Website. For example, we may not be able to recognise your computer or
mobile device and you may need to log in every time you visit our Website or
Services.

We may provide publicly accessible bulletin boards, blogs or community forums on
our Websites. Any information that you choose to provide in these forums may be
read, collected or used by others who visit these forums, including to send you
unsolicited messages. We have no control over the collection, use and disclosure
by third-parties of Personal Information which you may choose to submit in these
forums.

If you provide a testimonial to be displayed on our Website, it may include
information such as name and title. We will always obtain your consent prior to
posting any testimonial. 

If you provide us with unsolicited Personal Information which is not lawful for
us to collect, we will, as soon as practicable, destroy that information. 





5. HOW DOES OBJECTIVE USE YOUR PERSONAL INFORMATION?  

Above we have outlined our purposes for collecting your Personal Information and
our use of it. This section provides further detail.

We use your Personal Information for a variety of purposes, depending on the
nature of the information, but always only if reasonably necessary for our
business, including providing you with the Services. We will not use or disclose
your Personal Information for a secondary purpose unless we are allowed to do so
by law, you have consented to that use or disclosure, or we are legally
compelled to disclose it.

We generally use your Personal Information to: 

 * Allow you to create an account and log in, in order to obtain access to and
   use the Services and customer support. 
 * Contact you about your account via email, mail or telephone to tell you about
   certain things, such as changes to our Services or policies. 
 * Send you news and information (including direct marketing) about our Services
   that you either request from us, or we believe may be of interest to you and
   you consent to us sending you these communications. See Section 6 below for
   how to stop receiving these communications. 
 * Internally analyse user behaviour so we can improve our Services. Some of
   these activities include monitoring, maintaining and improving our Services
   and features, personalising your experience, creating new services or
   features, preventing undesirable or potentially illegal activities, and
   investigating any complaints about or by you. 
 * Evaluate your employment application if you have applied for a position with
   us.

 





6. UNSUBSCRIBING FROM MARKETING COMMUNICATIONS. 

You may choose to stop receiving our newsletters, direct marketing or other
promotional emails at any time, by either:

 * following the unsubscribe or opt out instructions included in those
   newsletters/emails; or
 * contacting us at our contact details in Section 17 below.

Where you opt-out of receiving these messages, this opt-out will not apply to
any Service-related communications (and any processing of Personal Information
about you involved in sending such communications). Service-related
communications are typically connected to us performing and/or managing the
applicable customer contract for the Service. 

 





7. HOW DOES OBJECTIVE STORE AND PROTECT THE PERSONAL INFORMATION IT COLLECTS?

It is important to us to keep your Personal Information private and
confidential. We take all reasonable steps to ensure that your Personal
Information is handled securely and in accordance with this Privacy Policy and
our information security policies and procedures. 

We hold the Personal Information that we collect on systems that are owned or
controlled by us in controlled environments with approved user access, which are
not available to the public. These systems are located primarily in Australia,
but our Affiliates in New Zealand, the United Kingdom, Singapore and the United
States also hold Personal Information. 

We maintain physical, electronic and administrative safeguards that are designed
to protect your Personal Information from loss, misuse, unauthorised access,
disclosure or alteration. However, due to the inherent risks of the internet and
malicious third-parties, and despite our efforts to protect your Personal
Information, we cannot guarantee the security of any Personal Information
transmitted over the internet or stored in any of our or our service providers’
systems. 

You also play an important role in protecting your Personal Information, and you
can assist our security measures, and the security measures of our service
providers, by using a complex and unique password for logging into each of our
Services, and by keeping that password secret and secure. If you suspect there
has been any unauthorised access or misuse of your Personal Information, or your
password or login details, please contact us immediately. Our contact details
are in Section 17 below.

We also utilise third-party service providers that may store and/or process some
of your Personal Information – please see Sections 8 and 9 below.





8. WHO DO OBJECTIVE PROVIDE YOUR PERSONAL INFORMATION TO / WHO MAY HAVE ACCESS
TO IT?

We will only share your Personal Information with third-parties in the ways that
are described in this Privacy Policy or with your consent. 

We may provide your Personal Information to:

 * Our Affiliates, where required due to our Affiliates helping us with the
   supply of the Services, customer relationship management, technical support
   for the Services, and administrative support (e.g. centralised Finance, IT,
   Operations, HR and Legal functions).  
 * Service providers that provide services to us in connection with our business
   operations and/or the supply of the Services (including hosting providers,
   marketing tool providers, and financial, accounting and sales management
   service providers). Service providers are only authorised to use your
   Personal Information as necessary to provide their services to us.  
 * Sponsors and promoters when you enter any competition or surveys that we
   conduct or promote. 
 * Regulators, law enforcement agencies, information security agencies or other
   organisations that may need to be notified of or protected against fraudulent
   activities, or if you engage in or threaten any unlawful activity, or if we
   undertake a police screening check. In those circumstances, we may reasonably
   conclude that it is necessary to disclose your Personal Information to
   government agencies, your internet service provider, your employer or any
   other organisation. We may also be compelled to disclose your Personal
   Information by a court order.
 * The Australian Stock Exchange due to Objective Corporation Limited’s status
   as a listed company or during divestment activities in the event of a sale of
   all or a portion of Objective’s business or assets.   
 * Your referees, former employers, educational institutions and credit
   organisations if you have applied for a position with us.





9. DOES OBJECTIVE DISCLOSE PERSONAL INFORMATION OUTSIDE OF YOUR COUNTRY OF
ORIGIN? 

Our servers that hold your Personal Information are primarily based in
Australia. However, some of our Affiliates / offices are located outside of
Australia – in particular, in New Zealand, the United Kingdom, Singapore and the
United States of America. There may be times when your Personal Information is
stored, transferred, disclosed or processed by our Affiliates in those
countries, for the purposes described in the ‘Our Affiliates’ heading in Section
8 above. 

As noted in Section 8 (under the ‘Service providers’ heading), we use service
providers to assist us with our business operations, and such service providers
may be based outside of your country of origin. We use service providers that
are located in Australia, New Zealand, the United Kingdom, Singapore and the
United States of America (and they may have operations outside of those
countries), and we may disclose your Personal Information to those service
providers in connection with the services they provide us. 

We endeavour to ensure that all overseas recipients of your Personal
Information, whether Affiliates or service providers, store and process your
Personal Information under appropriate safeguards and information security
controls. We always use reputable service providers, and we enter into contracts
with such service providers that include appropriate privacy protection and
information security obligations.

This Privacy Policy applies regardless of where your Personal Information may be
sent, stored or processed.  

Australia is a member of the Asia-Pacific Economic Cooperation (APEC) Data
Privacy Sub-Group, which in 2004 developed the APEC Privacy Framework. Under
this Privacy Framework, all member APEC states agreed to adhere to basic
principles of data privacy protection when personal data is transferred between
member states. New Zealand, the United States of America and Singapore are also
APEC members and accordingly are bound by the APEC Privacy Framework. We adhere
to the information privacy principles set out in the APEC Privacy Framework. 

Any Personal Information stored or processed by our Affiliates in the United
Kingdom is subject to the UK’s Data Protection Act 2018 and the UK-specific data
protection scheme that operates in the UK following Brexit.





10. HOW LONG DOES OBJECTIVE KEEP PERSONAL INFORMATION? 

The period for which we keep Personal Information varies according to the nature
and use of the Personal Information. In some cases, there are legal requirements
to keep Personal Information for a minimum period (for example, if it forms part
of a Commonwealth record, or it must be retained due to a court or tribunal
order, or where we are under a contractual obligation to retain it). If there is
no such legal requirement, we will only keep the Personal Information for so
long as it is necessary for the purposes for which it was collected, or as
expressly consented. If we no longer need your Personal Information, or we may
no longer store and/or process your Personal Information due to your request as
described in Section 11 below, we will destroy or de-identify it. 

If you apply for a position with us, and if your employment application is not
successful in the first instance, we may retain your Personal Information for a
limited period so that we can consider you for other positions that may become
available. However, if you do not wish us to do this, please notify us using our
contact details in Section 17 below, and we will comply with such notice and
delete your Personal Information.





11. WHAT ARE YOUR RIGHTS RELATING TO YOUR PERSONAL INFORMATION?

ACCESS RIGHTS

You can ask us to give you access to a copy of the Personal Information we or
our service providers hold about you. 

There may be instances where we cannot grant you access to the Personal
Information we hold.  For example, we may need to refuse access if it would
interfere with the privacy of others or if it would result in a breach of
confidentiality. If this happens, we will notify you in writing; otherwise we
will comply with your request. 

CORRECTION / UPDATE RIGHTS

You can ask us to correct or update any incomplete or inaccurate Personal
Information we or our service providers hold about you, and we will comply with
your request.

We make all reasonable efforts to ensure that your Personal Information is
accurate, up to date and complete. You can update your Personal Information at
any time via the account settings page or through your profile. 

OBJECTION TO PROCESSING / SUSPENSION OF PROCESSING RIGHTS

You can object to us processing your Personal Information, including for direct
marketing, where we are relying on our Legitimate Interest as a legal basis for
such processing and you object to that legal basis. 

You can ask us to suspend processing your Personal Information while you
determine the reason for the processing or the accuracy of your Personal
Information.

You may choose to change access to, or limit the use or disclosure of, your
Personal Information by contacting us (at the contact details in Section 17

be charged to cover our administrative and other reasonable costs in providing
your Personal Information to you. We will notify you if this applies. 

We will not charge you for making any request(s), and we will not charge you for
making any corrections or updates to your Personal Information.

While we will not be able to provide you with a personalised experience if we

13. WHAT HAPPENS IF OBJECTIVE CAN’T COLLECT YOUR PERSONAL INFORMATION?

If you do not provide us with the Personal Information described above, some or
all of the following may happen:

 * we may not be able to provide Services to you, either to the same standard or
   at all;
 * we may not be able to provide you with information about our Services that
   you may want, including information about special promotions; 
 * we may be unable to tailor the content of our Websites to your preferences
   and your experience of our Websites may not be as enjoyable or useful; or
 * if you are applying for a position with us, we may be unable to consider your
   employment application.





14. USE OF YOUR PERSONAL INFORMATION BY A CUSTOMER OF OBJECTIVE

Objective holds information (including Personal Information) on behalf of some
of its customers (Customer Data). The scope and nature of Customer Data is
determined solely by our customer and we do not ordinarily use that Personal
Information for our own purposes. The use of Customer Data is governed by the
contract between us and our customer.

Although Objective requires its customers to comply with applicable local
privacy laws (including the Australian Privacy Act 1988 (Cth) if the customer is
located in Australia), it does not review, monitor or have any control over
Customer Data or the way in which our customer uses the Customer Data. As such,
we bear no responsibility in respect of any (Personal Information which may form
part of Customer Data, except as provided by law or as set out in the contract
between us and our customer. If you have any concerns about the way in which an
Objective customer is handling your Personal Information, you should contact
that customer directly. 





15. OUR POLICY TOWARDS CHILDREN

Our Websites and Services are designed for adult Users, and we do not sell our
Services to children. We do not knowingly collect Personal Information about
children or from children. If you become aware that an individual under the age
of 16 has provided us with Personal Information, please contact us using our
contact details in Section 17 below. If we become aware that a child under 16
has provided us with Personal Information, we will promptly take steps to delete
such information.

You may request that we delete Personal Information we collected from you and to

of exceptions (where we and/or our service providers may retain your Personal
Information), and we will notify you if any such exceptions apply in your case;
otherwise we will delete your Personal Information and tell our service
providers to do the same upon your request.

We confirm that we will not ‘sell’ your Personal Information to any third-party
