Employsure Mutual Limited (Employsure Mutual) is a member owned discretionary
mutual fund with over 27,000 members. Through its product, Employsure Protect,
Employsure Mutual provides discretionary protection for legal representation and
liabilities arising from employment relations and health and safety claims.

Membership of Employsure Mutual is exclusive to clients of Employsure. Members
benefit from the improved risk profile that comes from the delivery of
Employsure’s core services to members that share common issues, resulting in
lower overall claims costs. By pooling contributions for discretionary
protection, Employsure leverages the strength of its membership to manage claims
and reduce overheads.

understand the risks and challenges of running a small business. The board can
exercise discretion in areas of membership, scope and cost of protection and
claims.

MEMBER BENEFITS

All members of Employsure Mutual, as clients of Employsure, have the benefit of
the following:

 * Access to employment relations and health and safety consultancy services
 * 24/7 advice service
 * Tailored employment and health and safety solutions to suit the Member’s
   business
 * Assistance with improving employment and health and safety practices

 * Reduced risk of an employment relations or health and safety claim
 * No excess on a claim for discretionary protection
 * No increase in contributions payable due to claims for discretionary
   protection
 * Limit of $400,000 on any one claim
 * Limit of $2 million per annual protection period





HOW TO JOIN

Employsure Mutual is available exclusively to clients of Employsure Pty Ltd and
Employsure Limited (collectively, Employsure) who are invited to join. As a
member, there is an automatic invitation to apply for the Employsure Protect
product. Clients are given the opportunity to complete an application form and,
if accepted, offered membership and the Employsure Protect membership benefit.

As a provider of discretionary protection, the Employsure Mutual board has
absolute discretion to provide protection. This means more flexibility and
higher percentage of claims covered compared to other financial products such as
insurance.


TWO TYPES OF PROTECTION OFFERED

Full details of the protection are contained in the Product Disclosure Statement
and should be carefully considered to determine whether the product is suitable
for you. The advice contained on this page is general and does not consider your
personal objectives, financial situation or needs.

In order to have the benefit of protection Members are required to seek and
follow advice from Employsure on becoming aware of circumstances which may give
rise to a claim (see exclusions listed at Clauses 4 and 6 in Part 2 of the PDS).


EMPLOYMENT RELATIONS


Members have a right to claim for losses they are liable to pay in respect of an
employment claim including unfair dismissal, general protections and
discrimination.

 * Judgments or settlements
 * Investigation costs


HEALTH AND SAFETY



Members have a right to claim for losses suffered when a claim is made by a
regulatory body for liabilities arising from a breach of health and safety
legislation.

COVER INCLUDES:

 * Legal representation costs
 * Penalties, where permitted by law (AU only)
 * Reparation costs (NZ only)




PERFORMANCE OF EMPLOYSURE MUTUAL

Employsure Mutual has successfully provided protection to members since it
commenced on 1 April 2019. In its first three years of operation:

 * More than 3,650 claims have been received by Employsure Mutual
 * During the 2021/2022 financial year, Employsure Mutual received 1,169
   employment claims and 182 notifiable health and safety incidents
 * Average settlement cost $5,158 per claim
 * Average cost of legal representation $3,600 per claim
 * 18% of claims declined due to members failing to seek and follow advice from
   Employsure


PERFORMANCE OF EMPLOYSURE MUTUAL

Employsure Mutual has had a successful first year of operation since it
commenced on 1 April 2019.
 * Accepted and managed more than 700 claims for protection
 * Average settlement cost $3,800 per claim
 * Average cost of legal representation $3,250 per claim
 * 67.3.% of claims protection granted

The protection provided by Employsure Protect is a financial product and is
issued by Employsure Mutual Limited (AFSL 544 232) (Employsure Mutual).
Employsure Mutual has appointed Employsure Pty Ltd as its Authorised
Representative 001274577 and authorised it to provide general financial product
advice and to arrange for the issue of Employsure Protect to clients. Employsure
Limited has been appointed by Employsure Mutual to handle distribution as a
discretionary risk product in New Zealand.
