Review Your Options Based On The Outcome Of Your Test Get Free, Confidential Debt Advice And Start Reducing Your Debt Explain me The process which we follow for legally challenging credit agreements is supported by the Audit Report - which is a detailed legal analysis of the credit agreement followed by a litigation process where an agreement is found to be unenforceable. The stages are: 1. Undertake a legal Audit of the credit agreement - Following receipt of the original Loan Agreement paperwork from the lender, the Audit is completed manually by a solicitor who is expert in the intricacies of the Consumer Credit Act 1974 (CCA). The Audit Report is close to 30 pages long and examines in depth the paperwork issued to the client at the point where the credit was granted. Once completed the audit will conclude whether or not the credit was issued to the client in accordance with the CCA. It is worth remembering that when a lender issues credit to a consumer, that lender is asked to do one thing which is to simply comply with the Consumer Credit Act. If the lender does this, then there is no issue. On the other hand, if the credit was issued improperly and the terms of the Consumer Credit Act were breached in some way, the issued credit may then become unenforceable against the borrower. Lenders know this and it is stated very early within the loan agreements they issue to clients. The Audit also incorporates an Unfair Relationship Test which looks at the actual relationship the client entered into with the lender e.g. Unfair Relationships, PPI Mis selling and Hidden Commissions. By incorporating all of the above Ratio Money optimises a client's chances of succeeding with their claim!! 2. Establish whether or not there is a claim - Once a client receives back their completed report it will indicate whether or not there are any problems with their credit agreement. If it is clear the Lender has executed the Agreement fully in accordance with the CCA, the client can apply for a full refund of their Audit Fee. The claims handler, Ratio Money and subsequently the introducer make no money whatsoever on refunded cases. This is a deliberate strategy as we think it is immoral to profit from a transaction where the client is no better for it. This is a clear message and supports our ethos of being fair and transparent. 3. For a claim, commence litigation against the lender - If the Audit does conclude there were mistakes made in the issue of the Agreement, there are grounds to challenge the lender. The client will be placed into the hands of a solicitor and at this point will have a solicitor/client relationship. Any legal advice from here on will be provided by this solicitor. The solicitor will take on the claim and will do so by engaging in a "Conditional Fee Agreement." This is known universally as a "No Win, No Fee" agreement and means that in the event of losing the case, the solicitor is not paid. Thus, there is a powerful commercial dilemma in the solicitor taking on a case. Any firm wants to be paid for their services and as such, cases which are taken are cases the solicitor believes will be won. It is very similar to a Personal Accident Claim in that the solicitor will make a claim against the other side (i.e. the lender) to recover costs and disbursements. At this point the Solicitor will take out an insurance plan called After Event Insurance. This ensures that in the event of the case being lost, the client is indemnified against paying the legal costs as is normal for the losing party. The solicitor will then litigate the case until an outcome is reached - which as mentioned above is expected to conclude in favour of the client so that the debt will be written off. If the solicitor believes they can achieve a successful write off or substantial reduction in your debts, In the meantime you will be asked to complete a standing order mandate to your bank, or recurring card payment, so that when the solicitor believes you have a successful write off, or substantial reduction in your debts, they can start taking your monthly payments without a break in service. WILL MY DEBTS INCREASE WHILST YOU WORK ON MY BEHALF? Once you have instructed the solicitor to act for you, your debts must be frozen; your creditors can not pursue or take any payments from you and no interest or charges can be added. WILL I NEED TO GO TO COURT? No, you will not need to attend any court hearings as part of the process, and any communication from your creditors can be directed toward the Solicitor. HOW LONG WILL THE WHOLE PROCESS TAKE? The process will take only twelve monthly payments, but the solicitor will act on your behalf for as long as it takes to negotiate a successful write-off or reduction of your debts with your creditors. If this is longer than twelve months, they will not ask for further payments. WILL MY CREDIT RATING BE AFFECTED? There will never be a negative impact on your credit rating for going through this process, and in some cases, the solicitor will manage to actually improve credit ratings. It’s important to note that all cases are different, and this cannot be achieved for each creditor in every instance. WHAT IF I DON’T WANT TO GO AHEAD AFTER THE FREE REVIEW? Once your free creditor review is completed, the solicitor will contact you to discuss their findings. If you do not wish to continue at that point, they will close your file and inform your creditors that they are no longer acting for you. In this instance, no further payments will be taken.
