These restaurants failed their Nov. 20-26 inspections and were temporarily closed. Follow-upinspections are required. Operator states they wanted to be sure that the inspector saw everything up close and misunderstood the need for immediate cleanup. Cook returned to work after entering in back door, no handwash. Observed Sliced tomatoes at 2.5 hours (63F - Cold Holding); Shredded lettuce at 2.5 hours (64F - Cold Holding). Operator stated one half of reach in cooler unit at front counter is not working. Operator placed items in walk-in cooler to reduce temperature. Operator placed fresh items in functioning side of unit. Temperatures were less than or equal to 41F. **Corrective Action Taken** **Warning** SUMMERLIN CAFE 11370 Summerlin Square Dr, Fort Myers Beach Routine Inspection on Nov. 20 Follow-Up Inspection Required: Violations require further review, but are not an immediate threat to the public. 16 total violations, with 5 high-priority violations * High Priority - Employee handled soiled equipment or utensils and then engaged in food preparation, handled clean equipment or utensils, or touched unwrapped single-service items without washing hands. Observed employee loading dishes into the dish machine with gloved hands and then while wearing the same soiled gloves, unloaded the clean and sanitized dishes from the machine. Glove change and hand washing was needed. * High Priority - Raw animal food stored over/not properly separated from ready-to-eat food. Raw chicken stored over blueberry's and strawberries on cooks line. Raw ground beef stored over cut lettuce in tall reach in cooler on cooks line. Educated operator on proper food storage. And provided operator with DBPR Form HR 5030-099 Refrigeration Storage Guide in Spanish. . Repeat from 03-07-2023 **Corrective Action Taken** **Repeat Violation** **Admin Complaint** * High Priority - Stop Sale issued due to food not being in a wholesome, sound condition. Salmon packaged bearing labeling to remove from packaging prior to thawing, thawed still under reduced oxygen packaging in reach in cooler on cooks line. * High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. shelled eggs - ambient (75F - Cold Holding); pooled eggs (75F - Cold Holding). Per operator food had been removed from refrigeration 1 hour prior and is being used for service. Discussed Time As Public Health Control with operator. Repeat from 03-07-2023. As a repeat violation the importance of following proper protocol with this violation was reinforced with the operator. **Repeat Violation** **Admin Complaint** * High Priority - Time/temperature control for safety food, other than whole meat roast, hot held at less than 135 degrees Fahrenheit. On steam table sausage pattyn (107 F - Hot Holding), per operator sausage was cooked 45 minutes prior and placed in double pan on steam table. Operator began reheating. TROPICAL SMOOTHIE CAFE 13111 Paul J Doherty Pkwy #140, Fort Myers Routine Inspection on Nov. 20 Follow-Up Inspection Required: Violations require further review, but are not an immediate threat to the public. 3 total violations, with 1 high-priority violation * High Priority - Operating with an expired Division of Hotels and Restaurants license. License expired on 1/20/2023. **Admin Complaint** WHAT AGENCY INSPECTS RESTAURANTS IN FLORIDA? Routine regulation and inspection of restaurants is conducted by the Department of Business and Professional Regulation. The Department of Health is responsible for investigation and control of food-borne illness outbreaks associated with all food establishments. HOW DO I REPORT A DIRTY RESTAURANT IN FLORIDA? If you see abuses of state standards, report them and the Department of Business and Professional Regulation will send inspectors. WHAT DOES ALL THAT TERMINOLOGY IN FLORIDA RESTAURANT INSPECTIONS MEAN? Basic violations are those considered against best practices. A warning is issued after an inspector documents violations that must be corrected by a certain date or within a specified number of days from receipt of the inspection report. An administrative complaint is a form of legal action taken by the division. Insufficient compliance after a warning, a pattern of repeat violations or existence of serious conditions that warrant immediate action may result in the division initiating an administrative complaint against the establishment. Says the division website: "Correcting the violations is important, but penalties may still result from violations corrected after the warning time was over." An emergency order — when a restaurant is closed by the inspector — is based on an immediate threat to the public. Here, the Division of Hotels and Restaurants director has determined that the establishment must stop doing business and any division license is suspended to protect health, safety or welfare of the public.
