NO PROBLEM! With an EMPOWER HRA, you can reimburse your employees Tax-Free for premiums and eligible healthcare expenses…even if you don’t offer a Group Health Plan! EMPOWER’s Qualified Small Employer HRA (QSEHRA) and Individual Coverage HRA (ICHRA) allow employers to legally reimburse employees for individual coverage premiums and eligible healthcare expenses. WHICH PLAN IS RIGHT FOR ME? QSEHRA Best for Small Businesses ICHRA Employer Size Only open to employers who are not Applicable Large Employers (ALE). This means that a QSEHRA is only for employers with fewer than 50 full-time equivalent employees. Open to employers of all sizes. Group Health Plan Offering The employer cannot offer a Group Health Plan to any employees. Employers can segment employees by class and offer an ICHRA to one or more classes. The same employee cannot be offered a Group Health Plan and an ICHRA, however. Annual Employer Contribution Limits The QSEHRA is subject to annual contribution limits. Download our Employer HRA Guide for this year’s limits. There are no annual contribution limits. Can Contributions vary by Employee? The QSEHRA contribution can vary based on number of covered members and age. In addition to variations based on number of covered members and age, the contributions can vary by employee class. Effect on Premium Tax Credit for Employees Employees cannot opt out of the QSEHRA. The employee’s premium tax credit is reduced by the amount of the HRA contribution. Employees can opt out of the ICHRA. Employees cannot receive the premium tax credit if the ICHRA provides affordable coverage or if the employee does not opt out. Download our Employer HRA Guide for more details. Employee Eligibility Employers can exclude part-time and seasonal employees from the QSEHRA. To be eligible for reimbursement, a covered member must be covered by Minimum Essential Coverage (MEC). To be eligible for reimbursement, the covered member must be covered by individual coverage insurance or Medicare parts A and B or Part C. Can I offer a QSEHRA and an ICHRA? No. Employers should choose the best plan that meets their needs. Can business owners participate? Owners of C corporations can participate. However, 2% or more owners of pass-through entities like LLCs cannot participate. Can employees contribute to a QSEHRA or ICHRA? No. Can I offer my executives a plan with a larger contribution? No. the contributions cannot vary outside of number of covered members, age, and employee class. WHAT IS COVERED? QSEHRAs and ICHRAs cover IRS §213(d) expenses. Employers can set up the Plan to reimburse a subset of these expenses. Premiums * Individual health insurance coverage purchased on or off the exchange * Medicare (Parts A, B, or C) Health Expenses * IRS §213(d) including: * Office visit copays * Prescriptions * Dental visits * Eye glasses and exams * Insurance plan deductibles How can I choose the eligible expenses for my employees? Employers choose the eligible expenses when the plan is first set up. We can assist you during the initial setup call. What about employees who have insurance through their spouses' group health plans? An employee cannot opt into the ICHRA in this scenario because he or she is not covered by individual insurance. The employee would be ineligible for an reimbursement through the ICHRA. The employee would be eligible for reimbursement for a QSEHRA if the coverage is MEC. The employee could be reimbursed for health expenses that are allowed on the plan. The employee’s share of the premiums on their spouse’s plan can be reimbursed, but this is taxable to the employee. Most employers choose to exclude taxable reimbursements from the plan. Can unreimbursed employee paid premiums go through payroll pre-tax? Yes! EMPOWER can modify the plan document to allow employees to run unreimbursed premiums (for non-exchange plans only) pre-tax through payroll. HOW DOES IT WORK? Setting up a QSEHRA or ICHRA is easy because EMPOWER does the hard part! You and your employees will love how simple it is to use your plan. Step 1: Setup Meeting Once you decide on the right plan for you, EMPOWER will host a virtual meeting with you and your team to discuss the following: * Plan options * Contribution amount and frequency * Covered members * Eligibility * Eligible expenses * Start date * Carryover of unused funds into the next plan year * implementation timeline * We are here to answer your questions We will provide employers with the following documents based on the selected plan options: * IRS-compliant notice for employees * Plan Document and Summary Plan Description Step 2: Send Notice to Employees Employers are required to send an official notice to all newly eligible employees. EMPOWER provides you with an IRS-compliant notice and a welcome guide to distribute to your employees. Step 3: Employees seek Coverage Employees must purchase and maintain coverage to be eligible for reimbursement. Your employees will have time after receiving the notice to purchase coverage. EMPOWER provides an enrollment form for employees to provide the details of their coverage. Step 4: Employees get reimbursed Employees purchase eligible expenses and file claims to EMPOWER for reimbursement. EMPOWER substantiates all claims and sends reimbursement through check or direct deposit. All employees are required to attest to their current coverage when submitting claims. Claims sent without attestation cannot be reimbursed. Step 5: Reporting QSEHRAs and ICHRAs have reporting requirements during the year and on the employees’ W-2 form.
