EXACTAG – INFORMATION ON DATA PROTECTION WITH REGARD TO THE SERVICES PROVIDED
Exactag GmbH, Theodorstraße 178, D-40472 Düsseldorf (“Exactag“) collects,
processes and stores data on the website and the customer’s subpages for the
purpose of measuring reach, statistical analysis and business cost optimisation
on behalf of the customer.
1. LEGAL BASIS
Data collection is carried out in two fundamentally different ways and on two
different legal bases:
A. USER-LEVEL DATA COLLECTION
If the user has given his or her consent in accordance with Art. 6(1)(1) lit. a
of the GDPR, Section 25(1)(1) Telecommunications-Telemedia Data Protection Act
(TTDSG), the data to be processed will be collected on a user-related basis.
B. GROUP-LEVEL DATA COLLECTION (ANONYMOUS REACH MEASUREMENT)
If the user has not given his or her consent, the data can be collected
anonymously, i.e. without collecting any personal data, and in a grouped manner,
i.e. by randomly assigning the collected data to groups of users. It is
therefore impossible to draw conclusions about individual users. This anonymous
collection is absolutely necessary according to Section 25(2) No. 2 TTDSG in
order to carry out economic cost optimisations and thus guarantee the requested
service.
2. NATURE AND PURPOSE OF THE DATA PROCESSING
A. PURPOSE OF THE DATA PROCESSING
Exactag has submitted to the rules of the IAB Transparency & Consent Framework
(TCF) and is an approved IAB TCF Vendor registered with vendor ID 312. Exactag
evaluates users’ decisions stored in the IAB TC String for the following
purposes as defined in the IAB Europe Transparency & Consent Framework Policies:
Purpose 1: Store and/or access information on a device (Consent)
Purpose 7: Measure advertising performance (Consent)
Purpose 8: Measure content performance (Consent)
B. DATA COLLECTION WITH THE HELP OF COOKIES
Exactag uses cookies as technology to collect the data.
For the 2 different types of collection mentioned in point 1, different cookies
are used to ensure the respective type of collection.
A. USER-LEVEL DATA COLLECTION
The following data is collected as part of the User-level Data Collection:
* Timestamp;
* Geo-location from IP address;
* Marketing data, especially media contacts;
* Origin and destination page;
* Browser data;
* Customer parameters; and
* Conversion data, such as order number.
B. GROUP-LEVEL DATA COLLECTION
The following data is collected as part of the anonymous data collection:
* Timestamp;
* Marketing data, especially media contacts;
* Origin & destination page;
* Device type; and
* Conversion data without user reference.
3. RETENTION PERIOD
The retention period depends on the type of data:
* Raw data, i.e. touchpoints, onsite events (page impressions, visits, etc.),
conversion pixels and cross-device data: Maximum 6 months from collection;
* Conversion information (i.e. conversion parameters on an OrderID basis as
seen in the conversion list): Maximum 18 months from collection;
* Journey information (includes conversions, touchpoints, onsite events,
previous conversions, and external touchpoints in such a journey): Maximum 36
months from collection; and
* Cross-device data, i.e. connections based on a user key and the advertiser’s
cross-device key (1st party data such as customer ID or hashed email
addresses): Deleted 6 months after inactivity.
4. POSSIBILITY TO OBJECT
To ensure exclusion from user-level data collection, a cookie can be set in your
browser as an alternative to missing consent in the privacy settings. This
cookie is called “optout“ and is set by “exactag.com“. It may not be deleted as
long as you object to the user-related data processing. If you wish to object to
this data processing for the future, please click on the link provided by the
respective customer of Exactag from its website.

EXACTAG – INFORMATIONEN ZUM DATENSCHUTZ IM HINBLICK AUF DIE ERBRACHTEN
LEISTUNGEN
Exactag GmbH, Theodorstraße 178, D-40472 Düsseldorf („Exactag“) erhebt,
verarbeitet und speichert auf der Webseite und den Unterseiten des Kunden Daten
zur Reichweitenmessung, statistischen Analyse und betriebswirtschaftlichen
Kosten-Optimierung im Auftrag des Kunden.
1. RECHTSGRUNDLAGE
Die Datenerhebung erfolgt auf zwei grundsätzlich unterschiedliche Arten und
Rechtsgrundlagen:
A. USER-LEVEL DATA COLLECTION
Liegt gem. Art. 6 Abs. 1 S. 1 lit. a DSGVO, § 25 Abs. 1 S. 1 TTDSG eine
Zustimmung des Nutzers vor, so werden die zu verarbeitenden Daten nutzer-bezogen
erhoben.
B. GROUP-LEVEL DATA COLLECTION (ANONYME REICHWEITENMESSUNG)
Liegt keine Zustimmung des Nutzers vor, so kann die Erhebung auf anonyme Weise
erfolgen, also ohne jegliche personenbezogene bzw. personenbeziehbare Daten zu
erheben, und auf gruppierter Weise, also indem erhobene Daten zufällig Gruppen
von Nutzern zugeordnet werden. Ein Rückschluss auf den einzelnen Nutzer ist
somit ausgeschlossen. Diese anonyme Erhebung ist gem. § 25 Abs. 2 Nr. 2 TTDSG
unbedingt erforderlich, um betriebswirtschaftliche Kosten-Optimierungen
durchzuführen und so den angefragten Dienst zu gewährleisten.
2. ART UND ZWECK DER DATENVERARBEITUNG
A. ZWECK DER DATENVERARBEITUNG
Exactag hat sich den Regeln des IAB Transparency & Consent Framwork (TCF)
unterworfen und ist ein zugelassener Teilnehmer mit der Vendor-ID 312. Exactag
wertet die im IAB TC String gespeicherten Entscheidungen der Nutzer für die
folgenden Zwecke aus, die in den IAB Europe Transparency & Consent Framework
Policies definiert sind:
Purpose 1: Store and/or access information on a device (Consent)
Purpose 7: Measure advertising performance (Consent)
Purpose 8: Measure content performance (Consent)
B. DATENERHEBUNG MIT HILFE VON COOKIES
Exactag nutzt Cookies als Technologie, um die Daten zu erheben.
Für die unter Ziffer 1 genannten 2 unterschiedlichen Arten der Erhebung kommen
unterschiedliche Cookies zur Anwendung, um die jeweilige Art der Erhebung zu
gewährleisten.
A. USER-LEVEL DATA COLLECTION
Im Rahmen der User-level Data Collection werden folgende Daten erhoben:
* Zeitstempel,
* Geo-Location aus IP-Adresse,
* Marketingdaten, insb. Media-Kontakte,
* Herkunfts- und Zielseite,
* Browserdaten,
* Kundenparameter, und
* Konvertierungsdaten, wie z.B. Bestellnummer.
B. GROUP-LEVEL DATA COLLECTION
Im Rahmen der anonymen Datenerhebung werden folgende Daten erhoben:
* Zeitstempel,
* Marketingdaten, insbes. Media-Kontakte,
* Herkunfts- & Zielseite,
* Gerätetyp, und
* Konvertierungsdaten ohne Nutzerbezug.
3. SPEICHERDAUER
Die Speicherdauer ist abhängig von der Art Daten:
* Rohdaten, d.h. Touchpoints, Onsite Events (page impressions, visits, etc.),
Conversion Pixels und Cross-Device Daten: Maximal 6 Monate ab Erhebung;
* Conversion Information (d.h. Conversion Parameter auf OrderID-Basis wie in
der Conversion Liste zu sehen): Maximal 18 Monate ab Erhebung;
* Journey Information (enthält Conversions, Touchpoints, Onsite Events,
vorherige Conversions, und externe Touchpoints in einer solchen Journey):
Maximal 36 Monate ab Erhebung; und
* Cross-Device Daten, d. h. Verbindungen auf der Basis von einem Userkey and
dem CrossDevice Key des Advertiser (1st party data wie z.B. Kunden ID oder
gehashte E-Mail Adressen): Werden 6 Monate nach Inaktivität gelöscht.
4. WIDERSPRUCHSMÖGLICHKEIT
Um den Ausschluss von der nutzerbezogenen Datenverarbeitung (User-level Data
Collection) zu gewährleisten, kann alternativ zur fehlenden Zustimmung in den
Datenschutzeinstellungen ein Cookie in Ihrem Browser gesetzt werden. Dieser
Cookie trägt den Namen „optout“ und wird von „exactag.com“ gesetzt. Er darf
nicht gelöscht werden, solange der nutzerbezogenen Datenverarbeitung von Ihnen
widersprochen werden soll. Wenn Sie dieser Datenverarbeitung für die Zukunft
