TERMS OF SERVICES
By commissioning SkyeVoyant Designs, you, the client, agree to the following
terms and conditions.
Agreement:
By submitting a commission request, you, the client, hereby agree to the
following Terms of Service ("Terms") that regulate the contractual relationship
between you and SkyeVoyant Designs ("I," "me").
Intellectual Property Rights:
The Designer, SkyeVoyant, retains the intellectual property rights to all
original work created during the project unless otherwise specified in writing.
Privacy Policy:
I acknowledge that any sensitive personal and business information provided by
the client is considered confidential and will not be disclosed publicly. I
commit to maintaining confidentiality for legal and archival purposes.
Contracting of Services:
I reserve the right to decline projects that conflict with my internal
guidelines or those I cannot fulfill. Clients may inquire through
skyevoyant@outlook.com or social media. Commissions are not taken on a
first-come, first-serve basis unless stated otherwise. Once an invoice has been
sent, the first payment must be received within 7 days. If payment is not
received, I reserve the right to terminate the project.
Payment Policy:
Prices are agreed upon before the project starts and are not fixed on the
website.
Clients have two payment options:
1. Full Payment Upfront:
Pay the full amount at the start of the project.
75% refund is applicable if dissatisfied during the initial concept or sketch
phase.
2. Standard Payment Schedule:
25% non-refundable deposit before the project begins.
After the initial concept or sketch is approved, 50% of the total project
payment is due.
The remaining 25% is due upon completion of the project before the final
deliverables are provided.
Communication:
Ongoing communication and discussion will occur throughout the project.
Communication channels may include Discord, Twitter private messages, Email
(skyevoyant@outlook.com), or other channels according to my discretion. My
response time may vary. Please allow for up to one week for a response.
Timeline:
Timeline depends on the commission type and workload. Clients should plan
launches and streams accordingly. I will provide progress updates and seek
client feedback. Timeline may be delayed depending on client feedback turnaround
time. If response is delayed, I reserve the right to move on to a different
project.
Hosting Services:
I offer hosting services for websites designed by SkyeVoyant Designs. Clients
may cancel hosting at any time, and the cancellation will take effect at the end
of the current paid month. Clients are billed at the beginning of each month for
hosting services. I reserve the right to adjust the monthly hosting price,
providing a one-month notice to the client. Clients have the option to purchase
the source code and host the website themselves at any time if they are not
satisfied with my hosting services. If payment for hosting services is not
received within 7 days of the new month, the website will be taken down.
Uses, Credit, and Rights:
I reserve the right to post completed projects to my website and social media
accounts. Clients agree not to use project deliverables for derivative works or
commercial purposes outside of the initial intended use without prior
discussion. Clients must appropriately credit SkyeVoyant Designs on all social
media and streaming platforms where project deliverables are used.
Restrictions:
I do not permit the marketing and distribution of my work as NFTs or
facilitating AI platforms.
Terms of Service Changes Policy:
I may choose to revise these Terms at any point without prior notice. By
continuing to commission me, you agree to be bound by the revised Terms.
Blacklist:
Clients who violate these Terms may be blacklisted.
