OCCUPATIONAL SAFETY AND HEALTH NEWS ALERT MARCH 01, 2018 OSHA INSPECTORS AIM TO DISCOVER WHICH EMPLOYERS FAILED TO FILE 2016 ELECTRONIC ILLNESS AND INJURY DATA For clients and friends of Jackson Kelly PLLC Volume 14, Number 5 ©2018 Jackson Kelly PLLC On February 21, 2018, the Occupational Safety and Health Administration (“OSHA”) issued guidance on Interim Enforcement Procedures for Failure to Submit Electronic Illness and Injury Records under 29 C.F.R. § 1904.41(a)(1) and (a)(2). Employer establishments subject to OSHA recordkeeping regulation with 250 or more employees, or establishments with 20 or more employees in certain high risk industries, must submit completed OSHA Form 300A electronically. The deadline to do so for 2016 was December 15, 2017, which OSHA extended to December 31, 2017. Employers can no longer submit 2016 records. Zatezalo, Assistant Secretary of Labor for Mine Safety and Health, U.S. Department of Labor, testified before the House Subcommittee on Workforce Protections in a hearing to review “the Policies and Priorities of the Mine Safety and Health Administration.” An archived video of the hearing can be viewed here: https://youtu.be/Ke_z5vEH5Is. Questions posed during the hearing ranged from the Assistant Secretary’s plans to improve the efficacy and functionality of the Mine Safety and Health Administration (“MSHA”) to whether he plans to roll back the recent respirable dust and pattern of violations (“POV”) rules. OSHA AND MSHA PENALTIES ARE INCREASING For clients and friends of Jackson Kelly PLLC Volume 14, Number 1 ©2018 Jackson Kelly PLLC In accordance with the Federal Civil Penalties Inflation Adjustment Act, the Occupational Safety and Health Administration (“OSHA”), the Mine Safety and Health Administration (“MSHA”), and several other U.S. Department of Labor civil penalties are increasing. This yearly inflation adjustment, an approximate two percent increase, has a modest effect on penalties. Or, do you have more than 250 employees at one of your establishments where you keep OSHA logs? Have you submitted your 300a summary to OSHA? If not, do not worry as OSHA has extended the deadline to accept 2016 OSHA Form 300a data through midnight on December 31, 2017. OSHA will not issue enforcement actions against any employer who submits their reports after December 15, 2017, but before December 31, 2017. After December 31, 2017, OSHA’s website will no longer accept 2016 data. Posted on December 06, 2017 at 01:41 PM in Coal Mines, Metal/Nonmetal Mines | Permalink | Comments (0) NOVEMBER 27, 2017 OSHA DELAYS ELECTRONIC FILING UNTIL DECEMBER 15 For clients and friends of Jackson Kelly PLLC Volume 13, Number 25 ©2017 Jackson Kelly PLLC The Occupational Safety and Health Administration (“OSHA”) delayed the compliance date for employers to electronically submit their injury and illness data until December 15, 2017. OSHA finalized the regulation last year, which set forth new requirements for certain employers to electronically submit their injury and illness recordkeeping forms via OSHA’s website. Depending on establishment size and industry, covered employers must either upload their 300a or their 300a, 300 log and 301 forms. OSHA’s final rule on the matter is scheduled to be published in the Nov. 24 Federal Register. The delay allows “affected employers additional time to become familiar with a new electronic reporting system,” OSHA states in a Nov. 22 press release. In a recent hearing before the Education and the Workforce Committee, Secretary of Labor R. Alexander Acosta said OSHA is seeking to refine the regulation further and mentioned privacy as a concern. As a result, it is anticipated that OSHA will propose additional changes to the rule in the near future, however, it remains unknown what all those changes may be. DOT drug testing regulations, which apply to all modes of transportation regulated by DOT agencies, allow testing only for specific drugs listed in Part 40 of its regulations. This new rule expands that list.
