A will is an important legal document that allows you to specify how your property and assets will be distributed after your death. In Queensland, as in other states and territories in Australia, having a will is important because it ensures that your wishes are carried out and that your loved ones are provided for in the way that you want. There are several reasons why it is important to have a will in Queensland: 1. To distribute your property and assets: Without a will, your property and assets will be distributed according to the rules of intestacy, which are determined by the State or Territory in which your property is held. This may not align with your wishes, and could result in your loved ones not receiving what you intended them to. A will allows you to specify exactly how your property and assets should be distributed. 2. According to Queensland law, to be valid, a will must be clean and unmarked otherwise the testator will be deemed as being intestate (not having a will). More CASE EXAMPLE – CELIA PROVING A DISAPPOINTED BENEFICIARY HAD NO CASE Celia’s will was challenged by her daughter who had been excluded. We successfully represented Celia’s estate to defend her wishes. To do this, we we able to prove that the daughter was wealthy in her own right. More CASE EXAMPLE – MARGARET PROVING AN UNSIGNED COPY OF WILL EXISTED Margaret had accidentally destroyed her most recent will but her brother owned an unsigned copy.
